dfs nightmare continues but i won !!!

Well guys its now a week since i got my sofa and since day one i told them i reject it and want a full refund, so far ive had kevin the upholsterer out who agreed it had bits he could fix and bits he couldnt and he just confirmed this to me today on the phone apparently they have just faxed the manufacturer (in china ? ) and they will get a call back today with a result hmmm so i mentioned to him that derek the store manager was out last night and according to him its fine nothing wrong with the sofa and the stitching isnt a manufacturers fault and apparently the fact you can see the frame all the way round the back isnt wrong either, then he asks if i checked the back of the sofa in the store before buying it ? erm no i said do you ever check the back of a sofa and considering its a huge corner suite i couldnt move it even if i wanted to and also would the sales guys let me do that anyway ? silence at the other end of the phone so i said well kevin im glad we agree it has faults even although derek wont use that word he prefers customize and considering he says there is nothing wrong with it he still wants to customize it. (its at this point i want to say really bad swear words but i wont) so i repeat i want the sofa uplifted and i reject it and want my full refund just so were clear on the matter kevin.
As an after thought split second i push in my last sentence Oh and by the way kevin just to keep you up to speed with the matter ive contacted trading standards today and Fira and also im in the process of getting a lawyer. He says he will now call me friday no doubt after hes spoken to the boss derek who not being a professional upholsterer seems to think its fine anyway.
By the way i did tell him id drop the sofa off and he told me no store will accept the sofa so i have now contacted a newspaper judge and also watchdog and im also looking into court action.
Also from what ive read they only ever try to fix your sofa never refund money but after spending £2500 i will not bow to fixing it they should really have on display in the store with the price tag this sofa wont come perfect no matter how much you spend it will have to be fixed once you receive it !!!!.
Another tip after they tell you nothing is wrong contact trading standards and also get an independant upholsterer to give you a report on the sofa ive found it hard to find one that will do it mainly because they dont wanna end up in court as a witness but if you go to the furniture ombudsman website there is a bit where you can click for fira they will send someone out to look at it do a report and also send it to dfs for a cost of £50 firas tel no is 01438 777700.
So i guess i just need to dig in my heels stay positive and wait and see what happens meanwhile im gonna move my sofa into another room and bring in my old faithfull to sit on. Maybe we should all take our sofas all over the country to the stores and sit on them outside the stores and protest lol gotta laugh or id cry .
will try to keep you all posted and i hope ive given some helpful info.

    I don't understand why you have had an upholsterer out, tell them you are rejecting it and you want a refund.

    Hi they told me that he would have to come out to see it, i stuck to my story i was rejecting it and want money back he said he couldnt do that and would need to speak to the manager who then called me and came out and said there was nothing wrong with it but still wanted to customize it. They have also told me no store will accept my sofa being returned.

    I guess i just have to hang in there and stick to my guns last night i moved my sofa into another room to store it as i moved it underneath i noticed broken black plastic it was one half of a sofa foot and also the click system they use to put the sections together was on the floor broken.

    Hi all, well the store manager called me on friday at 6.30pm apologised for the late time he called basically without boring everyone to death on this dilema he told me again he wasnt going to uplift it or return my money i repeated im within my rights i told you the day of delivery the item was faulty and did the sale of goods act speech once more, he then said im thinking what if i throw a spanner in the works ah here it comes i thought, you see reading all the posts on here is very handy. He offered me another sofa anything id like even to the extent of they are bringing out a new line on the 27th june 30 new sofas so i said to him erm no if you can offer me a new sofa you can offer me my money back and uplift it and anyway i wont be buying another new sofa for a few months this dilemma has put me right off, and anyway i said what if the same thing happens again do you really wanna go through all this again with me cause i know i dont. I then told him been to fira and they will be doing a report on the sofa t/s also and will be taking it to the courts to sort out, silence on the other end of the phone so i said listen why dont we just cut to the chase you uplift it and refund me and you wont have to mention the word you hate to say ie faulty to me cause this isnt going away trust me, so the upshot was he is going to have a wee think about it over the weekend and is calling me today so im keeping my fingers crossed he will uplift because im within my rights, also another thing id like to point out is i moved the sofa into storage in my front room and 3/4 of one foot on one section of the corner sofa was lying on the floor in pieces and also the lever section that holds it all together also many more marks on the sofa which i told him was down to his men that put it in the house, i will be charging them storage for the sofa in the courts as they refused to uplift and one point he may not have thought about is that when it goes to court if i win i will be left with faulty sofa and my money back because again hes refused to uplift it and told me no store will accept it.
    keeping everything crossed will let you know what happens.

    If you read all the posts on dfs in this forum you begin to get a picture of how the company works and it helps when your fighting your corner and i cant thank everyone enough for helping me keep strong !!!

    Manager called me today and told me he was uplifting my sofa and will refund me in full im so dam happy:j so glad its over i really didnt think he would back down i guess its good I have a stubborn side lol

  • Well done, you've worked a miracle.
    Make sure you get a signed reciept for the item and I would take pictures of the exact condition it is going back in.
    It wouldnt surprise me if DFS denied knowledge of the refund or said it was sent back damaged more then it originally was.

  • thankyou so much i have just read all your threads,i have exactly the same problem with them.i paid £2500 for a corner suite & its utter rubbish,its leather & every seat is scratched or marked,i have had the DFS guy out & apparantley all leather does the same.I am now about to ring the number you posted...wish me luck

    Keep phoning fira if you havent received a form from then in two or three days call back im still waiting on the so called form from them thankfully i didnt need it but stay strong keep calm and just keep repeating sale of goods act im within my rights to refuse and for you to uplift it
    if you need anything please dont hesitate to let me know p.s. it wasnt the zara was it by any chance same as mine if it is.

    update - received full refund cheque in post today :j im so glad thats finally over i will never walk through their doors again thats for dam sure:T.......
