Samsung and Comet

Hello,

Could any one advise please. I purchased a TV from COMET in June 2008. It now has a defect that aTV engineer is diagnosing. If the fault is one that should not have occured within the time frame, who do I contact to obtain repair, replacement through the Sale of Goods Act?

    How long was your warranty? If it's out of warranty, it's out of warranty. If it's in warranty, then you needed to have taken up the issue with Comet directly, not called out a 3rd party engineer.
    No free lunch, and no free laptop ;)

    Complain to Comet first and if you get no joy there go straight to Samsung with the SOGA. I did and they paid for a new power supply (£200) as my parents supply packed in within 18 months.

    I did have to get an engineer out (£50 call out) but Samsung paid for that too once they had proof of the fault and a copy of my receipt from the engineer for the call out charge.

    This is precisely why Comet is down there at the bottom of the pile, along with Currys-Dixons, when it comes to proper customer service, a world away from John Lewis, House of Fraser and Richer Sounds.

    The Company Representative either has not got a clue about the Sale of Goods Act(s) or chooses to ignore it, and therefore abnegates Comet's legal responsibility.

    Simple question: should there be a reasonable expectation of a new TV lasting over 2 years without becoming faulty? Aside from the batteries in the remote, there are no consumables, so that the answer is 'yes'.

    By putting the onus back on to the customer, and asking them to fork out for an inspection, Comet is deliberately making life difficult, awkward and (sic) costly for this same customer.

    Only poor companies need representatives coming onto this forum, as to do so is in itself an admission of failure.

    Please honour your legal responsibilities, or, I can put it no more politely, kindly go away.

    This forum is about saving money, not about big companies using it to extort money unlawfully from customers.

    Now back to the original query.

    Firstly, your contract is with Comet, the retailer, not Samsung, the manufacturer. (Anything Samsung kindly agrees to do would be on an ex gratia basis.)

    Secondly, the Sale of Goods Act does apply. Your TV should be as described, fit for its purpose and of a satisfactory quality.

    Your TV has packed up within two years of your purchasing it. As long as its not due to misuse on your part, any reasonable person would expect it to last longer.

    (Any reasonable retailer would be of the same opinion.)

    Do not fork money out for inspections, especially not for one carried out by their staff! They are not impartial, by definition. Save it in case you have to take these sharks to the small claims court. In the meantime, write Comet a letter, send it recorded delivery, outlining the situation as you and the law sees it. You are entitled to a repair at Comet's expense.

    If Comet does not play ball you can take them to court.

    Mvee. You should take notice of the 2 posts above. After only 2Yrs you are entitled to a free repair or replacement (up to Comet which they choose), and don't be fobbed off with anything less.

    Is the fault clicking on and off on standby by any chance? If so Samsung are repairing for free, or replacing if unable to repair. It seems that loads of customers are having this problem after 2 or 3 years use.

    This is why I said in my first post that if you get no joy with Comet go to Samsung. This is the fault we had after 18 months use and it is a faulty power supply which costs £200 to be fixed. We had it fixed and the engineers report paid for. There was no hassle at all apart from waiting for the engineer to diagnose the fault.
