Mobile Phone Contract
Just asking for a bit of advice..
Ive been a customer of T-Mobile for 2 years now and i am currently 5 months into my new contract with them. I pay £31 a month for a Sony Ericcson W995 and £7 insurance. The phone has been in for repair once already due to no fault of my own. On taking the phone in they advised me that it would be gone for around two weeks but they did not have a phone for me to use in the mean time. I had to go out and buy a spare phone which cost me £40.
I rang T-Mobile today to inform them that the phone has broken again ( 2nd time in 5 months ) and explained that I should recieve a new phone as this is such an inconvienience.
The customer service consultant i spoke to was very rude and was not helpful at all. I was passed on to her manager who then had me on hold for most of the time which i was not happy about.
I recieved a call back from a complaints manager who was very helpful and explained that they have credited my account with the £40 that i spent on the spare phone so i was pleased. I explained to him though that i thought the customer service i had recieved was disgusting as i have been a loyal customer for 2 years.
He explaied that they could have my phone collected and sent off for repair which i refused as i think a 5 month old phone should not have broke twice. I told him i will be cancelling the contract which is an 18 month contract which has a pending payment of over £350 if i am to cancel.
Can i cancel the contract with out having to pay the amount that is due for the rest of the contract? As they are now threatening with court and a debt collection agency?

The basic answer is no. I think you're stuffed. T-Mobile (like some other networks) make a lot of soothing noises but are pretty poor. If I were you I'd do the best you can, continue with the contract and go elswehere the minute it's up. The alternative is to end up paying for it anyway but without the use of the bundle.
Other people on here may give you better advice but that is my own opinion. If you decided to sue them for the cost of a new phone as the one supplied is not fit for purpose you might have a case (others can advice on that point better than I can) but if you refuse to pay up it will not only land you with a debt chased by the debt collectors but will also ruin your credit rating for years to come.0 -

Basically No. The airtime side is working fine it's your hardware thats not.
You can *try* and get a reduction on the time the phone is away, buit that will be all you get.
You *DO* have the right to a repair or replacment, however that is the choice of the vendor, as long as they are willing to repair it then they are within the law.
If you could prove a design fault, you may have a better case, but given they gave you the £40 credit then you had to have a "spare" phone to use whilst the other one is in the shop you don't really have much to go on.
Try for the refund of the line rental but thats probably as far as you'll get.0
