Moving home with mum?

my situation is not really for money saving, but ideally i dont want to lose what i already receive. anyway here goes....

i am 22, a lone parent with 2 young children (3 + 5) currently living in private rented accommodation, covered by the local council. The property is a mess, ie - my bathroom radiator doesnt work, every winter (sept - feb/march) i get mould in the kids room, the front door has no seal so it rattles in the wind and lets a draft in, theres no loft insulation, cracks appearing down walls, the boiler trips out at least once a day and to top it all off the patio doors are now jammed shut/broken and the landlord has told me they cant afford to replace them and that i could be liable as i have over-used them!! i did have dogs in the property but they are now living at my mums as landlord said no dogs - which is fair enough.

living here is getting me down and i feel i am never going to get out of here. so i thought about moving back to my mums. she has a 3bed house with only her and my younger brother (18) living there. my mum is in financial difficulty at the moment and my brother is currently jobless.

does anyone know if i moved back home would i lose my benefits due to living with a parent or would i still be able to claim as i am my own family unit? or would my mum have to claim for the children?

    You can claim income support, child tax credit, child benefit and child support as your own family unit.

    all you would lose is your hb/lha as presumeably your mum and brother already receive full ctb. you just need to inform ctc/DWP of your change of address.

    Is your brother a full-time student? If so, your mum would lose her 25% council tax single person discount.

    You should all be a bit better off as the household bills can be split 3 ways, between you, your brother and your mother. Whether this will balance out with the inconvenience of having to share a bedroom with 2 young children is for you to decide.

    No neither of you would lose out. However it's a massive step giving up your house and moving in with your mum if you're doing it because of the disrepair to your property. If the LA don't do your repairs they are in breach of their statutory duties and you should contact a Housing solicitor or Shelter who can give you lots of advice.

    If you have your mother's house to go to, call the council out to do a property inspection of the property. Sorry, but private landlords should not be able to leave you in a home of disrepair. Sueless, the OP does state it's a private rental - so the local authority is not responsible for the repairs.

    There are rather strict guidelines as to what landlords must do to ensure that your home is fit for living in, and in particular, with small children. Something like your front door leaking the way you say it does - they cannot have that - it must be a proper fit. You might want to check out what black mould can do to your family, present your landlord with a copy of your findings, and, can't remember what it's called exactly, but there is a document which states a rented home cannot have black mould in it- and also lists a whole host of other things which the landlord must maintain to a proper standard.

    Has the boiler been checked in the last year? It should be certified as fit for purpose and safe each year of your tenancy.

    If you enjoy your independence, and you don't want to place strain on yourself and your family by moving in with your mother, then ensure that your landlord meets his obligations. Sounds like a cowboy of a landlord if you ask me!

    BTW - if you have an inspection done by the council, they will order your landlord to put the house back into good order, and if he refuses to do so, it will go to court where even the tiniest thing will require fixing to standard as well!

    Yes, I had started off meaning to say HB/CTB would be lost, but for some reason typed IS, CB and CTC would be lost!!!!:eek:
