However it's tax isn't legal any more.
The tax exemption certificate is fairly clear "it must be used for the benefit of the person named" (from memory).
The car is no longer owned/used by the person the tax disc was issued for, and the op is not disabled (unless he's forgotten to mention it), thus the car is no longer legally taxed under the condition of the class exemption, nor with the current disc as the exempt disc is not transferable if the vehicle is sold.
It might even be the tax disc is invalid because the person who has the certificate has used it to get a disc for his/her new car and that disc hasn't been returned.
I'd be having words with the garage, at the very least they've sold it without valid tax for him or anyone other the person the disc was issued for.
If the garage is not forthcoming with a new, legal disc, or refund to the value of, I'd be having a word with Trading standards and possibly DVLA as it was incorrectly described when sold (no tax), and the garage should know that the disabled tax disc is non transferable.
I'm not sure quite what the legal situation with regards to prosecution is, but I'm fairly sure it's classed as fraud to knowingly (mis)use a disabled exemption tax disc, as it offers a host of potential financial advantages not just the free tax (free congestion charge zone access if registered with TFL, from memory reduced/free toll road/bridge usage etc).0 -

I agree with Nilrem. The car probably would show up as untaxed on ANPR as the original owner would have had to retax their new vehicle, so that one would be null and void. I would definitely contact the dealer if i was you.Father Ted: Now concentrate this time, Dougal. These
