Leaving behind kitchen stuff

Hi, I'm selling my flat and wanted to leave behind the fridge, cooker and washing machine. I stated this on the fixtures and fittings list. Contracts have now been exchanged (completing next week), but my buyer has asked me to take away the cooker and washing machine but leave the fridge. This is a real pain for me! What's the legal implication if I don't remove the items?

    I'd think they were part of the contract now as you've exchanged, ie part of the fixtures and fittings so you can't unless you mutually agree then vary the contract. I'm no expert, speak to your solicitor.

    They'll soon go if you (or the new owner) put them on Freecycle, or whatever they call it these days.

    i have put them on freecycle already - but what annoys me is that the fridge can stay cos it's shiney but the poor cooker and washing machine gets cast out like their worthless !!! the appliances may need therapy if they find out how cruel and harsh they have been judged !!!!

    How will you like it if you move into your new home and someone has left behind a whole load of stuff you dont want.........

    just because you have offered them (because you cant be bothered to move them) does not mean to say the new owners have to accept them....

    Don't tell them...... Or just say that they were too good for the new owner, who is a cruel and heartless man and would doubtless have abused them. They'll get over it.

    Are they in working order? Surprised they haven't gone on Freecycle :(. People must be rich in your area! I put a washing machine on (it was already second hand when I had it) and got over 20 requests for it. Maybe you could try again, drafting your offer to make them sound more appealing.

    The fixtures and fittings list is part of the contract.
    You have Exchanged Contracts.

    If you do NOT leave them, you will be in breach of contract.

    True. If the purchaser has signed for the property as described in the contract then they don't have a leg to stand on really.

    have found a new home for them on freecycle - I'm sure they'll be very happy - and they have managed to get adopted by the same family so hopefully no abandonment issues !
