Sorry to drag up old posts - but my Ill Health Retirement appears to be going through
There is, however one question - can an employer set a demand in the T&C of accepting Ill Health Retirement - that a recipient is NOT ALL0WED to take up "any" paid employment again ?
If so - how does that stand up against the governments incentives to try to get everyone back to work ?
And more importantly - benefits (if government wants me to work - but I will lose my pension if I do......)0 -
Can I ask...if someone aged 60 takes medical retirement paying around £360 per week occupational pension, does that amount totally bar them from claiming ESA?
They would not be claiming any other benefits.0 -

I am only 47 and already claim DLA !!
My Ill Health Pension will pay out around £600 per month - which (in my mind) should entitle me to ESA (with a reduction of £32.50 per week) - ie (150 - 85)/20 -
I'm getting an ill health pension and CB ESA, my ESA is reduced due to my pension being over £85 a week.
I've also wonder if I got another job (very unlikely) I would loose my ESA which is fair enough but I might also loose my pension...
As for have a pension of over £360, how I understand it; you wouldn't get and money because the pension would cancel out the ESA payments but you would still get the your pension credits which adds to your old age state pension.
This may all become a pointless thread since the new rules are the CB ESA will only be paid for 12 months (CB JSA is only paid for 6 months), I don't know the finer details of when the 12 month will start from or if you'll still get pension credits etc0 -
Broadly speaking, there are two types of ill health pension - one given to someone will never work again, and the other to someone who will never do their current role again. The former will normally have to be surrended if the recipient begins work again.Gone ... or have I?0

The one I'm referring to is simply paid when the person is unable to continue their own employment due to ill health.
Three medicals were needed before the pension trustees agreed to accept that the ill health pension is justified.
They reserve the right to review it at any time prior to age 65.0
