These shoes were from BHS if that makes a difference....

I got some from BHS for my son for school last September - within 2 weeks they were knackered. The shop said exactly the same to me although I argued that they were in their schoolwear section. Mine were slip on, loafer types with little rivets in - these had dropped out within days and after 2 weeks the front of the shoe was coming away from the sole.

I sent them back to their Head Office with a strong letter and received a cheque for the value of the shoes plus my postage within a week or so and a very nice letter.

Unless he took scissors to the shoes stick to your guns - what on earth do they think little boys are going to do in their shoes, sit on the sofa and admire them??

thanks for the replies everyone - I'm glad it's not just me then1

I've decided to follow the advice of consumer direct - They've sent me an template letter stating that I do not wish to accpet the shoes as they are not of satisfactory quality, as per the sale of goods act. I'll send that recorded this evening at the sorting office and give them 14 days to respond.

They weren't expensive shoes, but it's become a principle now!!

Unless he took scissors to the shoes stick to your guns - what on earth do they think little boys are going to do in their shoes, sit on the sofa and admire them?? That made me laugh Belfast Girl - he certainly isn't the type to be doing that!

OP - did you have the shoes fitted or just pick them off the shelf? If you had them fitted they usually ask the purpose so that's an additional argument for you to use. (Sorry, don't have a BHS near so I don't know if they do 'fitting'.)[/QUOTE]

they weren't fitted - OH just picked them up.

    • Therefore shoes that have lasted only 8 days are not fit for purpose or of satisfactory quality - none of this nonsense that they are not everyday shoes, you expect people to wear shoes everyday - I would continue to fight.
    • the lady at consumer direct said the same - she said not to get bogged down in letter about the customer services woman stating they weren't for everyday wear. At teh end of the day, shoes are shoes and should last for longer than 8 days.
Sorry for all the posts - not sure how to multi-quote

I don't think you are being unreasonable and I don't think it makes a difference where you bought them; if the sole has come away after a maximum of 8 days wear at school, then they are not 'fit for purpose' or of 'satisfactory quality'

    Quote:
The Sale of Goods Act 1979 (as amended) says that goods should be:

    • The seller’s to sell.
    • Of satisfactory quality - Goods must meet the standards that any reasonable person would expect, taking into account the description, price and all other relevant information. In some circumstances, the retailer may be liable for any statement made by the manufacturer about the goods. Satisfactory quality includes the goods' appearance and finish, safety and durability and freedom from defects (including minor faults).
    • Fit for purpose - Goods of this type are generally sold for this purpose. They must also be fit for any specific or particular purpose made known to the seller at the time of the agreement.
    • As described - Goods should correspond with any description applied to them.

Therefore shoes that have lasted only 8 days are not fit for purpose or of satisfactory quality - none of this nonsense that they are not everyday shoes, you expect people to wear shoes everyday - I would continue to fight. I usually find I get a better response at the weekend in a very busy shop when I demand to see a Manager ...

    Agree with above post.

I cannot believe the shop thinks it is OK to call this wear and tear; what, 8 days' worth of wear?! Disgraceful.

Even if it were garments, you'd expect them to last several washes, if you followed the care label instructions? I thought if the items were not made well, you're entitled to some sort of exchange/ alternative, or even a refund.

you're not being unreasonable by asking for a refund, they are being unreasonable for expecting you to accept their response. Tell them the refund is not coming out of their wage, and clearly there is a manufacturing fault! I doubt they'd just accept this as wear and tear if they found themselves in your position.

    Sorry, rant over!:D

i dont see what difference it makes if they were school shoes or formal shoes. you should expect to be able to wear them far more than 8 times.
i think its disgraceful the way you have been treated here. and id be expecting them to put a big sign up beside them "dont buy these if you want to wear them more than once" lol

    hope u get a refund.

I do massively sympathise with stores.

You have no idea the amount of chancers you have on refunds, and I know personally of a case where a woman has only ever bought one pair of school shoes for her child, and she lets them batter them, and she takes them back for a replacement every time saying they are unsuitable, hence she hasn't bought school shoes for a very long time.

Go back another day and speak to another person. You've got to have some sympathy for the customer services desks whos job is to prevent people chancing the store. I'm not saying this is what you are doing, but people do get very wary about refunds sometimes, especially if you are liable to be in trouble from those higher up above.

If you don't get any joy, just speak to head office. I would never recommend these types of shoes for school though, Clarks type shoes are always hard wearing, whilst Kids department shoes just don't stand up to the same type of quality.

I juat wanted to point out that while I did state my case and did try and get the lady at the desk to see my point of view, I wasn't aggresive, strident or raise my voice in anyway.
I worked in a callcentre for enough years to know that it's unlikely to accomplish anything except getting her back up and raising my blood pressure. That's why I've chosen to go put the complaint in writing rather than go back and argue with the shop again.

  • I buy my sons shoes from Brantano. Last September he had a new pair for school. He only wore them for school. By the beginning of November the sole had come away from the upper. I took a chance & took them back (still had the receipt - that in itself was extremely unusual for me:cool:).

They exchanged them immediately no arguing. I was very pleased and secretly amazed.

2nd pair lasted 5 weeks - took them back, [STRIKE]complained again[/STRIKE] didn't have to actually complain as such, I just showed them the shoes and they exchanged them again!

    Excellent service.

Stand by your guns (I know I didn't have to, but now I know it is possible to take them back if they don't last I wouldn't hesitate to do it again if I needed to - this last pair are still going strong now, thankfully)
