Getting out of a Vodaphone contract (less than 30days)

I took out a contract with Vodaphone for 24 months , i was given a free phone HTC Legend, a few days after having the phone, i notice the battery life is awfull 4 hours max with all things like 3G, facebook etc.. all off, which kind pf ruins the idea of having a smartphone? so i took it back to Vodaphone and they replaced the phone again. Few days later i had the same problems. so i took it back to the store, and they said would l like another legend, i said no thanks its to much hastle, having to download all my apps again and numbers. I then saw the HTC Desire which was £30 a month so i said ill stretch to that, the woman in the shop said we are out of stock, she said were getting some in the next week, i said ill have the Google Nexus 1 if you can do that for £30 as the Nexsus one is £35 a month, she said she could not, so i deeside to wait a few days to see if they get the Desire back in stock.

A return a few days later, to ask if they have any in stock, they still dont! i said do any other stores have any in, she lookmed on the computer and a store about 1 hour away had them in stock i said i will drive down there to get it. So i drove down to this other store, where i spoke to a assistant, she said she can't authorise the transaction, as her managers not in, she would phone her... so she did but she got no answer, she said could i come back in 2 hours, so i said ok, i wondered about this town got 2 hours, i returned back the store and the assistant said her manager would not let her do it, so i explained how i came from another store etc....

So i now ring Vodaphone up, explain my story of how im paying to use a phone i can't use, the man on the other end, offered to cancel this months bill for me. I then the next day return to the store i got my contract from, they still dont have the phone in stock.

i want to cancel my contract, its been less than 30 days, what are my options!

    I can understand that you have had to do a lot of running around. But sadly there is no cooling off period for store purchases. I find it hard to believe you got two faulty phones with a four hour battery life to be honest.

    The main question to ask here is whether the phone was bought online or instore?

    Online and over the phone, you have 14 days to return it; providing you complained within this timescale, they MAY let you return the phone (they don't have to as you're >14 days).

    If bought instore, the following applies-

    -There is no longer a 14 day return policy in store for phones
    -If your phone develops a fault we can swap it anytime in the first 28 days from your in store purchase
    -If you find you have no network coverage you can cancel within the first 7 days.

    The phone gets really hot and last 4/5 hours - i think this could be with the Android OS - allot of people have this problem, google it :)

    I purchased it from a Store.

    I would be happy if they could give me the Nexus one for £30 a month ?

    Im waiting now until they get them in stock, but its been over a week :(

    No cooling off period in store, once you sign thats it. The phone seems to be faulty so you probably can get it swapped for a replacment but you will be unlikely to be able to cancel the airtime contract on those grounds. The airtime contract is not related to the performance or not of the hardware.

    Swapping for a N1 at £30 a month, no chance. I've been told by a few people that Google are demanding the £35 a month and there is no wiggle room. Plus Vodafone know they are the only ones doing it. You either pay the full price or don't get the phone. Sorry...

    Also do remember that as the phone is new, you'll be using it a LOT, so the battery life will be poor. My iPhone gave me about 9 hrs off the first few charges, then went up to about 48 hrs, once I started not playing with it quite so much. I doubt this is a fault.

    Doubt it's a fault, you'll be using the handset alot because it's new, and the new battery will need around 10 full charges before it is properly conditioned.

    Interesting how you believe it to be a fault with Android yet you want another Android handset

    I would second that. When I got my G1 I played around with it the whole day and the battery went down within hours.

    After you set up everything and don't install and uninstall apps all the time it will last much longer. It also helps to switch off Bluetooth and Wifi when not used and use 2G only when not downloading big amounts of data. My battery lasts now for 1 - 2 days, depending on my usage...

    I have a Nexus One and the battery life is really good. Even when using WiFi tethering to my laptop.

    After some butt kicking i got the Nexus one for £25 a month with 600mins unlimited texts and unlimited internet usage.

    The phone had a fault as i got posts from forums and showed it them, after a long talk with the manager i got what i wanted :D
