Play.com sent two items not one

I ordered an item from Play last week and received it within a few days. Problem is that the package included the same item, and a receipt for the item addressed to another purchaser.

I contacted Play, and they said send it back, but I'm unhappy about that as I don't trust them to refund me the return postage.

Can I send them a letter requesting that they arrange for pre-paid postage, or collection and give them a deadline?

    Or ask for a pre refund before sending it back. If you go to the post office they'll give ya quote.

    It counts as unsolicited mail. You are legally obliged to keep the item safe until they can arrange collection for it. There is no duty upon you to either pay for postage or spend unreasonable amounts of effort on it, e.g. going to the post office, filling in forms etc.

    Best just to contact Play.com saying you have the item. And they (or their representatives) can collect it from your premises at a time which is convenient for you.

    I think you have a reasonable right to ask them to pay for postage but I don't think being too obstructive will win you any friends.

    It still counts. He didn't ask for it, therefore is unsolicited. The fact that it came as part of a package he did order, and that it was indeed a mistake is not relevant here.

    No, don't be a PITA. However the fact remains that the OP should not be out of pocket by a single penny financially because of this. And he shouldn't have to spend too much of his time on it either. Obviously he's going to need to spend some time on it, that's unavoidable. But it should be reasonable, e.g. he should not be expected to take a day off work to wait in for a courier for example.

    Your point about it being unsolicited is actually irrelevent, if it was truly unsolicited he'd be able to keep it as per Consumer Protection (Distance Selling) Regulations 2000 Reg 24(3). As it's obviously an error Play need to be informed.

    Just send them an email confirming what you said and state that the package is here for them to collect at a convenient time for yourself, make them do everything.

    Thanks everyone for your help and suggestions.

    I certainly don't want to be a pita, and having spoken to Play they said put it in a letterbox marked return to sender. Very helpful - not - as the item is too big to fit.

    I'm going to write to them and say it is here and they can make arrangements to collect or send me a prepaid postage sticker and see what happens.

    I'm not going to loose much sleep over this as I'm doing them a favour!
