Speeding fine

Options
Sometime ago I received a fixed penalty notice for an SP30 (going over 30MPH in a 30 zone) as I am the registered keeper of the vehicle. It was my wife who was driving though so I sent the letter back with her details on it (I already have points). She duly received a fixed penalty notice which she filled in and promptly forgot to post. The next we knew this case has been heard in court and what should have been a £60 fine is now nearly £600 along with 6 points. I believe that there is no right of appeal at this stage, but is this fine correct? I read somewhere that the courts may double the fine from £60 to £120 but 10 times the original fine seems a little harsh.

Anyone shed any light on it for me?

To be £600 and 6 points, there's been something else going on. How fast was she actually doing? The penalty increases with the speed. Was it actually speeding she was charged with?

Did she receive notification of the conviction and how to pay? If it went to recovery because of non-payment, the Court Bailiff fees can easily rack up to £600 inc the original fine.

WOW that is more than harsh, I would ring the court that dealt with it and simply ask is this fine correct is it made up of other charges if so can you provide me with a breadown of charges please..........

(dont forget the please ;) ) I dont have huge experience with these things but do know a few people this has happened to (SP30's) 2 of them went to court and were found guilty and neither of them got a fine anywhere near that, there is probably some court costs in there as well, best thign to do is ring the court you may need to speak to the fines office, if paying it is going to be a struggle tell them most of the time they will allow time to pay (a reasonable amount lol) and sometimes after you fill in a SOA they will accept a payment arrangement as well.

Dont forget to update your insurance companies as well another hit to swallow.

Could it be that they are adding court costs in ?

Sounds like she received her own s172 request...failure to return this is 6 points + large fine.

I've looked again and that is what it says the fine of £525 is for. There's then £65 costs and another £15 costs.

Does this mean there may be another fine for the original speeding offence?

Is there any right of appeal for not returning the s172?
  • My wife has now spoken to the fines officer to arrange a payment plan but because of the size of fine she has been told she has to attend court on 07/06/10 from 2PM onwards to see them in person. As they don't have any appointment system I am having to take the afternoon off work to pick the kids up from school as she can't guarantee being back in time.

Appeal on what grounds? You've already said she didn't return it. So she gets fined. Harsh indeed, but that's the way it is.

    No.

If you have very good reasons for not returning it then, yes, it could be appealed.

Forgetting to post it isn't a good enough reason.
