Hardship Claim?

i just want to find out a little bit of info about making a hardship claim against LLoyds/TSB.

i was working whent he bank charges were taken but i lost my job 6 weeks ago and now have to claim jobseekers allowance.

can i claim harship now that i am out of work or would hardship have to have been claimed at the time the charges were taken?

    Are you really in financial hardship now? Losing your job 6 weeks ago doesn't necessarily mean you are in financial hardship. Take a look at the links in this sticky to see if you really think you qualify as being in financial hardship.

    Remember, even if you sucessfully prove you are in financial hardship, it doesn't necessarily mean you'll be given any refund; each case is assessed individually.

    I have been unemployed for 8 months, have 11k of mortgage arrears, £550 of gas arrears and am on medication for depression.

    Lloyds TSB`s solution....do NOTHING to help, patronize me
    in a sickening way and then add insult to injury by reminding me that I have an overdraft of £900 which they want repaying.

    Sorry to be so negative, but I would not hold my breath waiting on help from these scumbags.

    Bob, do you still use their account? What reason have they given for rejection of the financial hardship?

    Firstly let me say I went close to the top brass, Helen Weir
    ( Group Executive Director ) no less!

    My reply was from a Mr Jeremy Blake ( Senior Manager, Executive Complaint Team )

    There are lots of " We are sorry to learn of the difficult circumstances you find yourself in " and " " I realise " and " I do appreciate " very very patronizing.

    The bottom line is that they are prepared to do NOTHING to help.

    Disturbingly, he goes on to say that " I do appreciate, that as you are currently facing eviction from your home, why you would be seeking a refund of these charges from us."

    " I am satisfied that the charges you have paid are valid, and especially as a refund would not prevent your eviction, we will not be refunding them. "

    Eh! He knows that my mortgage company would not be appeased by the payment of a lump sum!

    I do not know this man, and do not think I would want to. If Lloyds TSB were a person, then I would be determined to hurt that person, and make them suffer. However as they are a massive organisation then it would appear that there is nothing I can do.

    In my opinion, Lloyds TSB are the very SCUM of the earth. Hey, just my opinion.

    If you're not happy with the response from Lloyds, and they have issued a final response, I would take it to the FOS to get them to have a look at your hardship case. The problem is that even if the banks or FOS deem that you are in financial hardship, this doesn't mean that they will refund charges. Perhaps you should open a parachite account to have your items going out, so that your money doesn't get swallowed up by charges and interest.

    i have been helping several friends and family memebers to get charges reiad back and on everyone one, the hardship claims have been refused.

    they say your problems now have not been cause by the charges so hardship claim doesnt even come into it. we wont refund a bean.they really are scum bags.

    not just lloyds - abbey has refused point blank as well.

    Financial hardship is about household income being insufficient to cover outgoings. The cause is not the charges but the situation is being made worse by it.

    At the point you reclaimed, were you actually using the account and did you argue your claim based on the income being insufficient as a direct result of the charges going out?
    Did you approach your priority creditors for help( for example, utility companies do have hardship funds that can be applied for)?
    Did you approach your mortgage company as well?
    I have not worked for NatWest Bank since February 2009

    i pointed those facts out to them and they didnt give a monleys. one particular friend, she had suddenly become a single mum and was paying everying off on her own and they didnt give a monkeys. that was abbey by the way. her income was certainly not sufficient to cover everything - it was a matter of a big juggling act. she was on benefits with two kids.and they didnt give a monkeys.

    No, I had stopped using the account about a year ago. I was still working then and my wages were being swallowed up by charges so I opened another account elsewhere for my salary to go into.

    To be fair, British Gas have not been hassling me at all, so I almost just forget about that.

    My mortgage company have been prety sound up untill now, but their patience is wearing thin and I have only just managed to get an eviction order delayed for a month or so.

    Whether I was to get any kind of refund or not, I would still not be happy with Lloyds. I hate their rhetoric,
    I hate their condescending tone and I even hate their TV adverts!

    I will keep at the scum fcuks untill such times as the Police class it as harassment and tell me to stop!
