    Undertaking is a bad idea no matter what... but if you have space to do it safely then the other drivers aren't using the lanes right.

    In a MLM situation I wouldn't undertake, but overtake them and make them aware of my presence. If they are in the outside lane needlessly I wont even hesitate and go straight past...

    Yes you can. You've actually quoted the relevent passage from the highway code in your reply! Where does it mention stationary traffic??

    I've had it done to me and didn't like it much. I pulled out to overtake a lorry in plenty time because I could see someone was in Lane 2 and they would be alongside if I'd pulled out any later. They overtook in Lane 3 and then cut right across my front going back to Lane 1. Obviously they had to pull back to Lane 2 a couple of seconds later.

    No, it isn't. It is frowned on in this country because drivers are too dim/badly trained to be aware of what is going on around them. The advice in the Highway Code is not to do it, but this does not have the force of law. The plod may do you for driving without due care and attention, but there is no absolute offence of overtaking on the inside.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    Where does it say the vehicles have to stationary? Does that mean on two carridge road with car slowing down to turn right I can't pass him till he's stopped.

    Undertaking in theory should never be necessary. On urban motorways at peak times it is often unavoidable.

    The police would prosecute for careless driving, but that would require a lot more than just passing on the left- high speed differential/over the speed limit for example.

    I often end up undertaking folk due to traffic conditions, but other times more dubiously, as I'm in a faster moving exit lane- the police seem to look the other way these days, similar to the no buses in lane 3 rule.

    I am wary however of undertaking muppets in lane 2 without a care in the world. If they move over, you could end up in trouble.
