Ex refusing to sign to take my name of joint bank account.. HELP?

I am currently going through divorce (which he also refuses to sign). And am filing for a DRO but I need to take my name of the joint bank account. He gets his JSA paid into their and pays his bills through it, but if he gets into any debt I will be liable.

Because I am going through divorce proceedings is there anyway I can take my name off without him? He is using it as his own, so I want nothing to do with it. Its a basic Nationwide cash card so has no overdraft etc. Thanks.

    Why not go and see the bank and ask if you can remove your name, I am not sure what the procedure is but it would be surprising if you were not allowed to remove your name. If the answer is no then ask them what their advice would be. The good thing is that it is just a basic account so he cannot run up any debts which would make an already difficult situation worse. Just be glad that there is no debt, all the best.

    It's entirely possible to incur significant bank charges, and unauthorised overdraft interest on the Cash Card account via DD, SO, and Bill Payment abuse...

    Bank will only remove your name if the account is in credit. Write to the bank and do it today, as you already know you will be jointly liable for any debt which he incurs.

    Not a nice situation to be in. I think most banks policy on Joint Accounts includes an "Account in Dispute" measure for exactly this sort of situation. If you tell them that your marriage is breaking down and your ex is playing hard ball, they should freeze the account - that is all incoming and outgoings will be frozen (so make sure you have everything you need from it first.) Do you have another account?

  • Sorry for delay in replying thank you for all your replies. I went into the bank and they will only take my name of it with 2 signitures, but only he can take the form in because they need to compare the signiture to the signiture on his bank card? So I have managed to persuade him to take the form already filled in, with a promise he will take it in in the next week. If he doesnt then I am stuck basically :(

    If you are a joint account holder you may as withdraw all the money in it :D?

    I hate to say it and I am usually a straight forward kind of person but onsidering his attitude I would get up nice and early on the day his JSA is due go and draw it out and then hold it to ransom, only give it him back after he accompanies you to the bank and hands the form in, I bet it would be donw quite quickly then :)

    Not the friendliest of approaches but then again he isn't exactly being co-operative himself is he....................................

    You can close a joint bank account with one signature....

    And you should be able to place a block on the account if it is in dispute.
