The fan costs very little. I replace fans for £30 including the cost of the fan. At the very most with the very worst laptop, it takes me 30 minutes. Most are easily accessible and take 5 minutes.
It is not something that you can get done under SOGA as a manufacturing defect. The life of a fan depends on how well you've cleaned it - I bet you've never blasted the dust out - and how much its operating. Many home ones run flat out a lot due to the heatsinks being clogged up by fluff from a lifetime spent being used in bed or on the knee. Most home ones I've bought for refurbishing for resale have heatsinks partially or wholly blocked up after 12 months.
