Getting out of t-mobile contract

i've been given a lovely shiny new iphone by my employer, with all bills paid (lucky me :))

Now i want to transfer my number from my blackberry, as I don't want to carry 2 phones around. My employer is fine with this.

Rang tmobile to get my PAC code - they said because I am contracted until Jan 2011, i will have to pay £180 cancellation fee.

I choked on my tea, had a bit of an argue but to no avail.

Apparently the £180 is my £30 a month contract x months to renewal.


I've had this contract for over 2 years now - originally it was 18 months, then i didn't need a new phone so I extended it again, not realising that i'd done it for another 18 months.

I didn't SIGN anything for the contract renewal... apparently they posted something but i was away travelling so no idea what happened to it.


So I don't want to pay £180 - are there any ways to get around this?

    Generally no, the best you can hope is to reduce the monthly tariff to the mimimum. You could also sell the original handset to help cover the remaining contract period.

    When you say you 'extended' your contract, what do you mean? Did you agree a cheaper monthly line rental in lieu of a new phone?

    Not signing a paper contract is not necessarily a 'get out', it can be verbally agreed over the phone for upgrades/extensions.

    Although it was a non hardware upgrade, it was still a contract agreement and a commitment and TMobile are within their rights to request the early termination fee.

    You will be unable to get a PAC code whilst the number is still 'in contract'.

    Since your employer is giving you a nice shiny new iphone and paying all the charges, would there be any chance they could help you with the termination fee. You would then be free to get your PAC and transfer the number.

    You need to remember that for tax purposes iPhones and Blackberrys are not classified as primarily being a phone and as such are classifed as company assets so different tax rules apply.

    By using the phone you agreed to the contract, a contract is a legally binding document, not usre why you'd just expect to get out of it for nothing

    As said in post 2, a renewal is a contract and it ties you in. They can be verbally done on the phone and you don't always receive paperwork.
    If you did not agree to it, then you would be on 30 day rolling (give 30 days notice to leave), instead you upgraded your contract which generally is either cheaper or higher allowances or a new phone (advances in technology apply to all 3 reasons).

    Also as above, if your locked in they will not give you a PAC code as using it terminate the contract. There is no other way to transfer the number, so unless you are willing to cough it up i would not bother. Instead just have a work and home mobile, my brothers have done it for many years as did my dad.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
