    I have considered doing my DMP by myself instead of with the CCCS but I'm really scared of going it alone. And to be honest i'm not very good at budgeting and think if i didn't have the CCCS to help I would be in an even worse mess. I just wondered about the whole full and final scenario, 3 of my creditors are credit card companies and all have pretty low balances. Barclay is roughly £250, Vanquis is roughly £500 but they have offered to reduce it to £350 if I can pay in full and Capital One is £190. I might be getting a bonus from work in June (not a definite), if i do is it worth offering to pay them off in full? I always thought that full and finals had to be made to all your creditors at once so I'm not sure if the CCCS would allow this but it would make me feel so much better!

    It would be possible to do a full & final on just one of your debts if you told CCCS and your creditor that, for instance, your mother is gifting you the money to pay off a particular debt. If you made it clear it was for one or more particular creditor/s, this would be OK

    I lost my Mum too, and I struggle with depression, and anxiety, so I feel for you.

    You're doing brilliantly, and remember, it is only money!

    I tend to let things get on top of me very quickly! Look at me, it's a saturday night and I'm still up (not partying) worrying about bloody creditors. I really must get some sleep and deal with it in the morning with a fresh head. But you're right, it is only money and i need to keep reminding myself that. Trouble is i'm just not sure what steps to take next. Do I sent all my !!!!!! letters to the CCCS and let them deal with it? Or do I contact my creditors and explain the situation? What do I do about the CCCS still wanting to pay citi and welcome even though i've clearly asked them not to? Confused :(

    ok me lovely lets take a step back and think on this one problem at a time..
    Firstly am sorry to hear about your mum - contacting someone like cruse can help as they are wonderful dealing with grief...also if youre feeling depressed go and see your Gp - it may be that antidepressants would be useful for getting through a tough patch and helping you to cope. There is no shame in not coping ...youve had a lot of stress (debts/travel) and emotional trauma lately so no wonder you feel overwhelmed.
    As for the debts I would say stick with CCCS but make the payments that were agreed and if you cant, you need to negociate - not just stop payments or you will be in danger of them no longer helping you and that would be BAD. Im sorry but I dont agree that swapping to CAB is a good idea - in my experience CCCS are fantastic and better resourced but you also need to stick to your side of the bargain for it to work...think of it locgically..you have asked them to negociate on your behalf by setting up a dmp and then have just gone your own way because you didnt like the fact that two companies didnt write back. Think of yourself in the creditors position - would you honestly do nothing if someone stopped paying you?!
    Im sorry if this sounds harsh - Im not at all but am worried that despite a DMP you are to a degree still thinking that it will all go away. It wont and the best way of handling it is to take control of the debts rather than they control you.
    Re money etc I think it would be a good idea to go back to basics and start an honest spending diary so you can see where your money is going....am about to do the same myself despite having been here for years :) sometimes we slip!!!
    So a big hug from me but also time to make positive changes to get rid of the debts once and for all and stop living under a cloud :)

    I've got a fresh head on this morning and can see things a bit clearer. InSearchOfMe, you're totally right, I do hope and pray that it's all just going to disappear, when quite clearly it's not. However, with regards to my CCA requests, I'm just following the guidelines on here so now i'm really confused and not sure what to do. Do I just give up on the whole unenforceable thing and go back to paying them? I love this site, everyone is so helpful but just at the moment I'm getting mixed views and I don't know who to listen to. Ultimately what I want (what we all want i suppose) is to get rid of my debt as soon as possible so I can get on with living my life.

    Hi -sorry to hear things have been going so badly for you recently. You have had a lot going on which has been out of your control and I'm sure you're coping as best you can.
    With regards to enforceability NeverINDoubt and RAS are pretty good on it and will guide you in the right direction.
    It's difficult - you seem to have reached a crossroads - whether to go down the enforceability route and full and final settlements etc or whether to carry on with CCCS. From what I've heard CCCS tend not to get involved with legal arguments about enforceability.
    I would try and find out from CCCS why payments have not been made for the last 2 months though and would have a think through a plan of action before contacting the creditors.
    I'm afraid I can't tell you the best way to go.
    But good luck with it all and I hope things settle down for you.

    I would kick some butt with the CCCS - threaten them that if they dont pay what their supposed to or at least refund you, then you'll have them reported to the authorities.
    As for this idea that "debts dont go away" - oh yes they do, if they are unenforcable in law (stat barred or no proof etc..)
    The industry would have you believe otherwise & would say anything to frighten otherwise.
    Its the DCA's that refuse to go away & are simply a social menace in this country.
    Do not pay DCA's a single penny ever! :)

    Making full and final settlement offers on some of the debts might be a good way forward - if you can afford to. I don't think you have to make full and final settlements to everyone though - I'm sure other people have tried tackling them one by one.
    I am sure there are threads on here on it - maybe start a new one for yourself if you can't find them? I'm sure people with the right experience then will see it.

    I can afford to tackle the small debts one by one, so I think I will go down that route. With regards to the payments i've made to the CCCS and the non payments to my creditors, I think the best thing for me to do is just write a letter to the CCCS to find out what's going on and take it from there. I know someone will probably say 'give them a phone instead of writing' but at the moment I feel more comfortable writing to them because I tend to get flustered on the phone and end up not asking everything and probably more confused than before the call. I think I'll also write letters to all my creditors just to let them know the situation, what do you think?

    Also my first full and final will be to Capital One, who I have a debt of £190 with, that's my smallest. Some of my larger debts have offered full and finals where they've almost halved the debt owed, however I've never been in a position to do so, do you think Capital One may reduce the amount if I offer to pay in full?
