I'm so sorry folks, I only seem to post on here when i'm feeling my lowest. I'm so depressed and things just seem to be getting worse. Everything's just going horribly wrong and there's nobody to blame but myself. My debt's are just out of control and everytime i feel like i'm getting somewhere i get kicked back down again. Started my DMP with the CCCS last year and i haven't made much progress. First of all my boiler packed in and had to be replaced so i stopped my repayments for a few months, then at christmas my mum died and left behind alot for me to deal with financially and emotionally. I finally picked myself up and tried to get things in order so I started by trying to claim back unauthorised charges from RBS and TSB both of which have been denied by the FOS. Then I wrote to Citifinancial and Welcome requesting my CCA's, neither replied within the time frame given so I told them I would stop paying them until they do. I wrote to the CCCS and told them to stop paying these 2 companies and I reduced my payments to cover just my remaining creditors. Since then I had to go to Houston to work for a few months and I just arrived home last night to a pile of mail which I've just gone through. Most of them from angry creditors demanding full payments, some have even offered reduced settlements. I've only just gone through my emails too (all 1500 of them) to find one from the CCCS saying that they can't stop the payments to these 2 companies and will continue to pay them anyway. Trouble is the CCCS hasn't paid any of my creditors for the past 2 months now even though I sent them reduced payments. Where has the money gone, what do they do with it? I don't know what to do, I'm really upset and just want to curl up in a ball and hope it all goes away.

    One of the worst things about the wretched debt industry in this country is how it makes people feel.
    None of these creditors/DCA's have any legal powers over you whatsoever - all they do is rely on threat and intimidation.
    The minute you stand up & fight - they'll soon back off.
    If any DCA's are threatening you, then report them to the OFT and trading standards.
    Refuse to answer security questions should any phone you.
    Do not pay DCA's a single penny ever! :)

    I get really wound up sometimes and would consider myself a very weak person, so I let these things get to me. I just feel like there's no end in sight. I can't imagine my life without debt :(

    I just want these people off my back. Is it worth doing debt consolidation instead of my dmp?

    No - you just pay what you can afford in a "like it or lump it sort of way" - if that means a £1 per month then so be it.
    No court would make you pay more than you can afford anyway
    Have you checked weather any of these debts are enforcable in law?
    DCA's usually dont have the correct paperwork (a CCA) & thus, cannot enforce/collect on a debt ;)

    I have sent requests to both Citifinancial and Welcome, neither of which sent anything within the timeframe I gave them so I sent them both letters saying my payments will be stopping. I haven't heard anything back from Welcome but I've received a copy back from Citi that i've just had a look at. To be honest I have no idea if it's enforceable or not. One thing I have noticed is that the copy they've sent me is not actually up to date. I actually topped up my loan 2 years after taking the initial one where a new agreement was made which included the old one. Should I be asking them for the later one?

    Can't help with advice on money matters honey but just wondered if you'd considered bereavement counselling or even given yourself time to grieve, it could make anyone feel overwhelmed when dealing with so many worries at once.

    I just want to say that (in my view & from my experience of them) - the CCCS are utterley useless.
    You'd be better off not trusting them with a penny & just sorting out all your affairs based on what you can afford yourself etc..

    Not sure that I have much help to offer but just wanted to write and say that I really sympathise, having debt is rubbish and its worse when the people who are supposed to be helping are completely useless. It might sound like an odd option but what about citizens advice? They are supposed to be really good at this sort of thing and I think could really help.

    Also Chin up, you started getting rid if your debt under a year ago and you have already paid down £6,000. That is a real achievement, well done. SJ

    Just remember the basics:

    A county court is there to help you (contrary to what DCA's would have you believe)
    Regardless of weather a creditor has the correct paperwork or not - you can only pay what you can afford (£1 per month etc..)
    DCA's have no legal power to any money off you whatsoever.
    Refuse to answer security questions should any phone you.

    Once those basics are adhered to, then everything else falls nicely into place ;)
