Third Party iS Liar

I was involved in a small collision over 3 month ago.
I don't want to discuss the accident but it was the third parties fault.
I got my car Fixed.
Wrote and statement drew I a diagram.
Was wondering why it was in dispute and taking so long and yesterday I got the third parties statement. I expect it slightly different as they are disputing liability. The statement is very long story which is a couple of pages long. The statement is very different to what actual happened, it doesn't even seem like it was the same accident. It is a complete work of fiction. There is also lot opinions in the statement and it is written in manner to make me look like not a very nice person.
I have replied to the email as instructed to by my insurance company.
But i am worried.

Do you have any independent witnesses? police report? CCTV?
If you have no independent evidence or compelling forensics (bald tyres), then I'm afraid it will almost certainly go 50/50.
I know that's frustrating but it's very likely to be the outcome.
The insurer will not spend thousands of pounds getting lie detectors, profilers, psycologists and forensic scientics involved.
It's just simply not worth it.
Both insures will simply just agree to go 50/50.

My only suggestions would be to make sure you have a camera (mobile phone is fine) and take as many pictures as you can of pictures of vehicles, damage etc.
If at all possible try to get witnesses.
I realise this isn't always possible, but if there are people delayed by the accident you should stop them (in the orad if necessary) and ask them to be a witness if they saw anything.
I know he's lying, but how do they know your version is 100% correct.
I'm not saying you are a liar, just pointing out the difficulties for the insurer.0 -

Last accident I was in was about 4 years ago.
Before I even spoke to the third party ( who was entirely to blame and the next day admitted full liability) I spoke to the driver of the car behind me. She was happy to act as a witness and stated that the third party's driving had been terrible.
Always get a witness - usually best before you even speak to other driver so there's less chance of the witness leaving.
The third party will almost always hang around - the witnesses don't so get them first.
Keen photographer with sales in the UK and abroad.
Willing to offer advice on camera equipment and photography if i can!0 -
Your liar has to be more believable then his liar, as when my ex had an accident I managed to disprove the fact that the others drivers witness who was a window cleaner could have had a clear view of the road especially as it was a dark evening, my ex's witness was more believable ;p0

I have a camera on my motorbike helmet that covers 180 degrees.
So anyone tries to lie against me and I'll HAVE EM.
Not just win the case, but hopefully get them for lying.
If there are blatant discrpeancies in their version i.e. things that cannot possibly be true, then you might be able to disprove/discredit them.I managed to disprove the fact
But again, I make the point that you insurer will not make huge efforts so it's up to you to do the running here.
The fact is it might costs them more to investigate than pay out, so you will have o do the work here is you want to discredit their version.0 -
Feel for you Ned, I'm in the same boat. I've got his version & am doing my draft reply this weekend(1st accident) No witnesses. But a few holes in his account so small chance to catch him.
Does anyone know if the insurers will look at googles "street view" to confirm markings/exits etc or should I do the running around like lisyloo says. Blood-pressure rising just writing this,!!!!!!.

I know google earth is YEARS out of date.
If you provide false information then the other side is perfectly entitled to call you a liar and pick holes in your story.
I'm not saying that to be nasty, but surely you can see the same logic applies to both sides.
If it's not a million miles away then go to get digital photos.
Get a cheap camera so that next time you can do it at the time and save a journey, but get witnesses FIRST before they drive off.0 -
It's hard to get witness and there was no traffic behind me. I was to shook up after accident going to talk to people wasn't the first thing on my mind.
I tried to take pictures on my mobile phone but the camera wasn't very good and it was dark. I managed to get only one picture. It's a close up of the damage to their car. The only damage to the car. Therefore i don't have picture of the other damage they have made up.
I'm worried because i wrote a few sentence on what actual happened but they wrote a story lasting a few pages of an almost a different event. I'm not as a good writer as they seem to be.
I have explain to my insurance company why the third party's version couldn't of possible happened i brought up few points. But i don't know if i can win a battle with just words. Like people are saying I can be accused of lying as easy as i can accuse them.0 -

I understand all you say lisyloo & welcome impartial views,that's what we need when we read a work of fiction but try & see the other sides view. We want to know what the insurers will be looking or do they just take a decision based on the details we send in.
In my case ,both say the road markings indicated different things,it's a 50mph roundabout so I can't stop for pics,but "street view"gives a good pic but it doesn't allow us to print the street view pic.Same with speed limit signs,they could be from anywhere as they don't have street names on them.
I,& probably Ned want the insurers to be in the drivers seat(both parties) & get a 380degree view,street view can be of help.
I'm sending in some pics, but accident happened last year & things have changed.Street view is out of date now, but the pics are as it was last year.Copyright is 2010 but it is last years layout.0 -
I had exactly the same thing happen to me, driving a relatives car on their policy as a named driver. I was in a Supermarket car park when a woman shot out of a side road straight into the side of my car. As you say, you are in shock and with me, by the time I had got out of the car and spoken to her the cars around had moved on so I had no witness to call on.
I did the usual statement and diagram and my car was fixed and I had to pay the excess to the repairers.
I claimed back the excess from the other parties insurers but it had only just been settled by them virtually 5 months later.
The delay they said was because the other party had disputed the events. Because of this they had passed this onto another part of their organisation who deal specifically with these type of cases. I think they were able to piece together the truth from the damage reported to them by the assessor from the repairers.
Don't despair as the Insurance companies deal with this all the time and it is possible when looking at the damge they will be able to piece together the truth of the situation.
The final insult for me has been however, my own car insurance has just come up for renewal and although this claim has now been settled in my favour as a 'no fault accident' my current insurers actually want to increase my premium because of it!!! Needless to say they will not be my Insurers for much longer.0
