MBNA payment due tomorrow and I don't have the money to pay it

I did tell him (Not Dermot!!) that the OFT guidelines were in place to prevent this type of harrassment, that I had no qualms in reporting them (haven't done that yet) and as I knew the guidlines in more detial than he did, perhaps he should go for re-training. I then hung up.
I do have DD1 in stiches over all this - she thinks its really funny how I handle these calls. I swear though, that mine are being recorded and used in staff training - on what to do with customers who think they know best! :rotfl:
LOL I wish I could think that fast on my feet. They totally knocked me for 6 when they called this morning, I've been up half the night with my ds who is ill again (think it's tonsillitis again
) and I was still sleep when they phoned. I also wasn't expecting any hassle because I thought my payment wasn't due until tomorrow and that as I had already phoned them to advise them of the situation I would have at least a few days grace before they started on me. How wrong was I

I dont do this everyday! Some days I feel a bit fed up with it all and refuse to answer the phone. I only answer if I am in a good mood and feel like "playing"!
And to start with, I behaved like a lost puppy as I didn;t know what to do. WIth lots of advice on here about what they can and cannot do, I felt much more confident in stuffing these bullies. I wont take it anymore. But at least while I have some fun then they are not calling some little old lady who can't handle it.
If you had missed your payment and NOT phoned them, you would have been charged a late fee and they would not be phoning you now - As you have told them you cannot pay this one, then they will keep going.
What is really wierd is that NONE of my OH creditors call him - only ever mine! They must know he is out!0 -
If they continue to phone, tell them that you are recording the phone call as further evidence of the harassment charge that you are bringing against them and then ask for their name. I imagine they will either end the call quickly or at the very least, speak to you in a better tone.
If they don't then start recording the calls and let CAB listen to it. Make sure you get them to name themselves though. If they refuse then simply hang up.0 -

So I should have just kept my mouth shut? Arrrggg it's so hard to know what to do for the right. I was under the impression that it's much better to be honest with co and they will treat you better in the long run. Looks like I was wrong there too

I am sure someone will correct me if I am wrong. But I am sure you CAN inform them not to contact you by telephone again and wish all further correspondence to be in writing. Make a note of each telephone call they make (times and dates) and report them for harrassment. I have already won a case for this with MBNA in the past, then two years later they tried it again when I reminded them what happened the last time all contact from them stopped.
Please dont let them upset you like this, I see a poster has already told you the likelyhood of what will happen should they actually take you to court, but I too very much doubt they will.
Write them a letter telling them to remove your phone number from their records under the terms of the data protection act and inform them of your appointment with CAB, the CAB rep also sorted out all our problems with the more difficult creditors two years back.

If you don't need it to be plugged in for emergency calls, I'd unplug the phone at night and replug at a reasonable hour. Then they can't catch you 'on the hop' while still in your nightie. They will ring very early to try and catch you unawares. Don't enter into any argument with them, keep calm, explain that you have written to them, and quietly put the phone down if necessary.

You can write to them like I did to the Customer Advication Office, MBNA at Chester Business Park. I have a draft letter somewhere threatening to report them for harrasment. I was bombarded at home with calls and even when I kept telling them NOT to ring me at work they still did. I once said to one of the cocky little sh*ts 'hang on a minute' left him on the phone while I made a coffee, went back and said 'No-just checked and my money plant still hasn't grown any and can't find the shovel to dig for treasure so have you got the message now?' he didn't like it one bit. How the h**l can you get money out
of a stone. Anyway, I'll stop rambling now, just to say that I got an apologetic response from my threatening letter, with a complaints form to fill in, AND - for 5 whole days - not had a phone call!! All I can afford at the mo is £1 token payments a month and thats what I keep sending for now. I was told you had to miss 6 payments then they sell the debt on so I suppose I'll be getting the phone calls back around January time.:confused: you are as you are, if you aren't as you ought to be.0 -
Just one little thing to add, if you are going to send an online payment from your bank make sure you use the details from the back of the statement which should say details for telephone/online banking. The ones on the front on the tearoff slip are for bank giro credits (usually made over a counter) and arent always the same as the ones for telephone/online banking. If you use these they normally reconcile the accounts in a different way and may not recognise you've sent it, which could cause more problems.

I may be wrong here - but I'm sure by OFT law it's illegal for creditors to advise you borrowing money to pay off a debt. If you tell them that and that you're recording the call they'll cack themselves!!!£2 Coin Savings = £0.23

I did actually mention that because I remember reading that here too. Her reply was that she was only trying to help and anyway getting a loan from someone in your family isn't really borrowing it is it
Then in the next breath she told me I had no right to appeal against any charges....which is when I lol'd 0
