Yes they threatened to take me to court for immediate payment of the full balance of the credit card plus court costs etc.

I knew they wouldn't be happy that I wasn't going to be able to pay the full amount but this is the first time ever that I have had a problem and I've had the card for 4 years now, it seemed like a very threatening and extreme answer. I think it's because I called them first to let them know there was a problem so they see me as a easy target for bullying.

Just pay them what you can by cheque if they refuse to do it on the phone, and get yourself the Payplan self-help pack which explains what to do next (https://www.payplan.com).

Even if they refuse your payment, still send it, as you are then complying with due stature (or whatever the saying is) and a Judge will rarely rule in their favour totally - it's also very unlikely they will take you to court for 1 missed payment (I have missed up to 4 sometimes without court action), they would rather continue to add interest and charges to the account than have a Judge freeze the debt.

I wish you the best of luck with them, I have two MBNA cards as well both similar situations.

I've looked at the payplan site and I can't find anything about a self help pack  just the phone number to call them but I've been told in the past that I don't have enough surplus money each month to be helped that way :(
  • Make a token payment through your bank. This will stop any calls coming until next month.
You will receive a notice with next months bill informing you that you underpaid and adding a late charge.
You should have seen the CAB by this time and have a strategy to move forward. MBNA are not easy to deal with. I've had months of problems with them. Things have eased somewhat now as they have accepted my reduced repayments after much haggling.
Good luck, I hope it works out for you

Thanks, I tried to pay through the mbna website but it wouldn't let me because I was trying to enter an amount less than the minimum payment amount.

I'm just writing a letter explaining everything (again lol) and am going to send a cheque with a token payment. I was planning to pay half my minimum payment but after they made it crystal clear they are going to slap charges on my account and hassle me no matter what, I thought I may as well just send a token payment and keep the rest of the payment for next month in the hope I might be able to pay the full amount next month. (does that make sense?)

If I get anymore phone calls I'll just tell them I've paid all I can for this month and I am the process of getting help from CAB and after that I'm just not going to answer the phone.

Only problem is it's all I can think about at the moment :( I feel like crying

    Looby,

the national debtline self help pack and letters seem to be quite useful.

Have a good cry if you need it, then it's time to get on with things.

    Take care.

arggggggggggg just had another call from them. My dd answered the house phone before I could get to it to see the caller display :(

Why do they think that my situation will be any different than it was 5 hours ago. I've asked them to stop phoning and told them I want all correspondence to be in writing from now on but the bloke who phoned said I have no rights ask for that and they can phone me if they like  Told them I have sent a token payment in the post with a covering letter explaining my situation and he said they will probably just refuse to accept it and add more charges to my account.

!!!!!! what do they want me to do, I haven't got a b!oody crystal ball I didn't know my life was going to get so messed up. I know I owe the money, I'm not trying to get away from that fact but at this point in time I just don't have it to give them.

If you cannot make a payment of less than the minimum amount on the MBNA website, then if you have online banking with your bank, set up a payment to them on there. Most online banks have this facility.

All you need is the sort code (6 digits) and bank account number (8 digits) for MBNA, and your MBNA account number (16 digits). You can find the details of MBNA's sort code and their bank account number on the pay slip that is sent with your bill or it will be listed on the back of the statement (I can see these details on my bank account online so could provide them to you as a PM if you wish but I cannot guarantee that they are still correct). This was how I used to pay them.

Thanks, I'll bare that in mind for the future, I wanted to make payment by post this time as I wanted to send the cover letter telling them about my change in circumstances and asking them to freeze interest for a little while. I don't think I've got a snowflake in hells chance of them doing it but it's worth a try I suppose.

Oh and I got a call back from the CAB, the first appointment they have is 25th September :(

MBNA told me this too - some time ago.

I did tell him (Not Dermot!!) that the OFT guidelines were in place to prevent this type of harrassment, that I had no qualms in reporting them (haven't done that yet) and as I knew the guidlines in more detial than he did, perhaps he should go for re-training. I then hung up.

I do have DD1 in stiches over all this - she thinks its really funny how I handle these calls. I swear though, that mine are being recorded and used in staff training - on what to do with customers who think they know best! :rotfl:
