Please help!!!- they sent me an empty cardboard box!

I bought some headphones from ebay, and did not receive then- it's been two weeks. I filed an 'item not received' claim via paypal, and then immediately, the next day, i received a recorded delivery package- on the package, it had the sticker identifying the company- company name, address etc. I opened it to find an empty cardboard box? I was like !!!!!!?

I phoned the company, and they lied, i mean they had answers for everything. They said, royal mail must have taken the earphones out, and replaced it with a cardboard box?

I don't know where I stand- is this something i should report to the police?

    Contact your local Trading Standards,if this is not a legit company,they may already have a file on them,if they do,follow their advice but in that case,the are probably creditors already so you'll have to join the line & wait for any outcome I'm afraid.

    It isn't a police matter.
    How much postage did they pay ? Let us know and this will indicate whether the box was empty from the start as from that, the weight can be guessed. Also, what kind of headphones were they ?

    Good idea- thanks. It was sent via recorded delivery, but it doesn't specify the cost of postage on the packaging, just the signed for barcode AG 0560 13760GB. The earphones: Carlsbro Headphones (Medium sized). You are right, the actual packaging is smaller, just enough to fit the cardboard in. This can be used for my defence so thank you very much!!

    Do an item not as described claim now, and send the empty box back recorded for refund.

    Its the seller's responsibility to get the goods to you.
    Leave it to him to deal with Royal Mail.

    Just phone up ebay, and tell them that you've just been sent an empty cardboard box after you opened a dispute saying an item hadn't arrived. If the seller tries to put this tracking number in to prove delivery, then dispute it, and again phone ebay to let them know this.

    The buyer has 7 days to send, so they will get no protection.

    If you've already opened an item not received dispute, you can't open another one.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    how long is left on the dispute?
    as for now the RD item doesnt track as delivered
