They said i have to email the seller and ask him to cancel the transaction... (what if he doesn't) and for the seller to relist the item as a BIN.... and then for me to buy it.... (and what if someone beats me to it..?!! Duh)

This all seems so ridiculous. And now the seller is ignoring me, but i could get an Unpaid item strike for this

If he has to relist, the best way to do it is to provide a copy of the original listing and have the title 'listing reserved for beeniecat'. Ask him to write this in the title and text of the listing, get him to list and send you the item number. I do this most days with bulk buys or items specifically ordered which are not in stock, it gives both of you Ebay and PP protection.

If he cancels the sale he will get back his fees. If he doesn't, you have evidence that you attempted to pay, so I wouldn't worry about a NPB strike. He also cannot leave you bad feedback (if it does go sour).

I'd ignore the seller then as well, let him pay his FVFs and as suggested above make sure you refuse nany mutual.

You've paid so if he tries an nPB just appeal it with the details of your original transaction number.
