Washing machine and comet

I need some advice here folks.
In Feb of this year I purchased a Panasonic washing machine from Comet and it came with a free 5 year warranty. 2 years as standard, the further 3 years after sending off a claim form and proof of purchase to Panasonic.
My form was returned with Panasonic saying Comet had opted out of this promotion at the end of Jan. When I looked at the machine instore the offer was still being advertised. i actually made the purchase over the phone when I asked clearly again if the offer was still current and was told it was. The claim form was delivered with the machine.
After a Comet "investigation" they have confirmed they did opt out of the promotion as described and claim there is nothing they can do.
I feel like I've been mis sold. I wanted a machine with a 5 year warranty and thought thats what I was getting. Apparently the sales call wasn't recorded so I have no proof that I was given the wrong information or that I looked at the offer being advertised instore.
What are my options now? I want what I was sold but without proof how can I go about this?

lol, just use the forum search and put in "comet sale of goods act" and you will see that you are dealing with a bunch of ignorant liars who believe that they are above the law and can interpret the act to suit themselves,a terrible company who i will never spend another penny with so long as i draw breath0

I brought my white goods through Comet and not a thing wrong, touch wood.
Saying that; I'd find out all the information you can, then armed with this go down to the shop or ring them with it.
If they still say no; ask to speak to a manager, if he says no then stand outside the shop telling everyone why they shouldn't buy there.0 -
I don't have a problem with the machine, its working like a charm. One of the main selling points though was the 5 year warranty which they now won't honour.
Its become obvious today that they are just going to keep saying no over the telephone. Time to get things in writing.
Does anyone know a particular section of the SOGA I could quote in reference to being mis sold? The machine is fit for purpose but I don't have the deal that was advertised.0 -
The machine also has to be "as described" under SOGA - I imagine this would include the guarantee..but something sticks in my mind to say it might notSquirrel!If I tell you who I work for, I'm not allowed to help you. Comet cant get out of it by saying "there is nothing they can do" that is a cop out. If things were as you say then the 5 year warranty was sold as a part of the contract.
I would write to Comet giving your version of events and giving them 14 days to sort it or you will take it to the small claims court. If they have already investigated then they already have the details to hand.
Comet offer a 3 year extra care product support package for between £134 to £169.99 depending on which Panasonic washer you have. As for the call being recorded they claim it wasn't.
I've written a letter stating the facts and keeping my opinion that they are offering a shocking service under control. What has been said today has been lie after lie. It was even claimed at one point that it was Panasonic that withdrew the offer. Even though they didn't I can't see what difference it makes as they still advertised and sold it to me as having the warranty included.
I am prepared to go to small claims. I don't have proof of a recorded call but I doubt Comet would be prepared to let an employee lie in court.

I am sorry to hear of the problems that you are experiencing regarding the promotion details when you purchased your Panasonic washing machine.
The offer of the free 5 year warranty was available on selected Panasonic washing machines that were purchased between 24 December 2009 and 20 January 2010.
Whilst the 5 year warranty promotion was initially scheduled to run through to 31 March 2010, unfortunately the offer was withdrawn on 20 January 2010 and replaced with an alternative cash back trade in offer. This was not a decision that was made directly by Comet, and affected a number of other retailers.
I am sorry we were not able to clarify this information when you were calling in to check, therefore, so that I can investigate your particular issue direct, I will need your purchase details so that I can look into this further for you, in order to do this could you please send me an e-mail at the link below.

The fact remains that if you sell a product with a 5 year warranty, then that forms part of the contract and there is no legal way for you to wriggle out of it!0
