    I have phoned up Orange and barred the sim card now, so it can not be used. Ive also told him if he doesnt either have it signed into his name or returned to me, i will be calling the police as its technically stolen, also advised to me by Orange. Hopefully now he will listen.

    Who asked you to put the contract in your name? Your friend or the Phones4u sales guy? If it was the latter, I would kick up a stink in their shop because they should never have suggested it, especially as the contract has your name and your friend's bank details. Proving it might be hard, but it wasn't just your friend who screwed you over, it was the sales guy.

    I don't agree. The person who take out the contract does not have to be the person who pays the bills. The OP knew exactly what they were doing when they agreed to sign the contract, and does not dispute that.

    You've got the sim blocked so he can't use the phone. I would also consider calling the police as the phone is stolen (in a sense). Although I don't think the police would do anything you may be able to use it to threaten him.

    The sales man at phones4u and yes i did know exactly what i was getting myself into. I guess you kind of dont expect to be screwed over. After a lot of effort, the person has believed my threats over the police, more so since the sim card was blocked and has agreed to sign it over into his own name. :)

    That is good news, hopefully it will be a happy ending. He your friend knew what was what all he has to do is hand over the phone and walk away without signing then he isn't breaking any laws.

    How many people who sell mobile phone contracts are fully aware of what they are asking you to sign ....very few of them.

    I have had a dispute with o2 and i was reading from their own T&C's and not one person on the phone or in the shop knew what i was going on about. I was even told by o2 that they are sales people, how are they meant to know what a contract says. If someone is selling me something i expect them to know what the ins and outs of the agreement are, hence why i always buy online, the terms are there and you can take as long as you like to read through them and call up and ask questions before if needed.

    In this case the sales guy was keen to put a sale through and being Phones4u tells all.

    Have the network done the credit check yet? They wont transfer it out of his name until they are sure that he's good for the money..
