Until blame is apportioned I believe both parties are held 'at fault'. My girlfriend has only just had a claim resolved in a similar fashion (in her favour, thankfully).Starting Debt: ~£20,000 01/01/2009. DFD: 20/11/2009 :j

Yep, the initial position will generally be to hold both at fault until they have assessed the circumstances.
Having said that if you feel they are not dealing with your claim properly then you are at liberty to formally complain which I suspect will concentrate their minds0 -
I had a similar problem a few years ago when I was knocked off my motorbike by a woman reversing out of a parking space. The claim took so long that my insurance policy came up for renewal before it was sorted. The renewal cost discounted my 5 years NCB as I had an outstanding claim and so the premiums were extortionate. Luckily though, as soon as the claim had been settled in my favour, the Ins. company had to refund me the difference between what I was paying and what it would have been with my NCB. They didnt want to, mind you, but I eventually got it out of them!0
