Annoying T-Mobile Calls

About 5 or 6 months ago I kept getting calls from a number (08454122750), if you picked it up there would be no-one on the other end and it would just hang up, at it's worst I was getting them between 20 and 30 times a day, after doing some research and finding out the number belonged to T-Mobile, my mum rang them and they said it was likely to be someone trying to sell me their mobile broadband, she asked them to stop calling me and they did.

However, I got a new phone in March, with a new contract but the same number and the calls have started again, I rang them yesterday and the woman on the other end said she "Didn't have the information" to stop the number, but would "Leave a memo on my account", today I have received a further 7 calls from this number, and I am quite upset that I have asked them twice to stop these calls and yet they continue.

Any advice on what to do next?
Thanks in advance,

I was going to suggust you read this - https://forums.moneysavingexpert.com/discussion/2467889
But im not sure if it is relevant.

I would take the matter up with T-Mobile complaints first. If the calls do not stop then move to OFCOM and ICO for misuse of data under DPA.

If T-Mobile is your provider, Sadly you can't use DPA to tell them to remove the number as the mobile number is required to be held by T-Mobile to run your account.

If T-Mobile is not your provider, then modify this letter, it gives them 30 days to remove your details from the system by using DPA, if they fail to do so they are breaking the law and the ICO will step in. - http://forums.moneysavingexpert.com/showpost.html?p=23625447&postcount=8
    Dear Sirs,

    Account No: XXXXXXXX

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls.

I withdraw my consent (under s.10 of the DPA) for you to process my personal data with respect to my personal or work telephone numbers registered with you or stored on your systems/records. The processing and use of these numbers is causing significant distress.

Advice from The Information Commissioner indicates that your retention of contact details in the form of a correspondence address is sufficient to fulfil contractual obligations.

This request supersedes any contractual provision that you may claim exists, and any attempt to claim otherwise will not be accepted or tolerated.

Under the DPA you have 21 days to respond to this request, and 28 days to cease processing and/or remove the data from your systems. Future use of my telephone number will be recorded and will indicate a breach of my request under the DPA, this will result in a complaint being raised with the Information Commissioner.

You will be deemed to have been served notice of my request and I will deem it served by *Enter date 23 days from date of letter*. I am advising you that any calls received after this date will be recorded with the intention of them being used as evidence.

    Yours faithfully

    Okay, thank you.
DarkConvict - T-Mobile is my provider, but I'm going to try the complaints department, if there's no luck I'm going straight to OFCOM
