it was a last minute decision to buy the car, so i bid then went to check it

im no expert on cars but was shown what to check for, it all seemed fine even on test drive
then on way back thats when the problems started first the dash went, fuses blowing, since then its been one problem after the next

Doesn't actually matter. Car is shoddy (thus not fit for purpose) and seller is a business!

Presuming they sold it in good running order, then the OP has a very high chance of getting their money back!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

No Auctions are exclused from DSR not SOGA.

    True, but...

ebay is not legally classed as an auction. Someone acting as a business would still be bound by the DSR if selling via ebay.

Wow, I didn't know that...can you explain a bit more.

I knew that BIN's were not considered auctions, so DSR applies but not all of ebay....can you point me to more info pls.

    Small claims are brilliant, but.....

make sure you send a Letter Before Action [google it], and most importantly.......

"never sue a man of straw"....which means make sure that the person you are suing has some form of assets that you could seize to gain payment [if they have no assets you will struggle to get a penny].

    Good luck.
