Help with LHA - Living with partners parents

Hi,

My boyfriend and I are planning on moving in with my parents from this summer.

My boyfriend is on contributions based JSA currently. And I am a full time uni student. He has no other income.

My parents would charge him rent. Would he be able to claim LHA housing benefit?

Also, on a seperate note...
We went to our local neighbourhood office to see if he could claim for LHA while we are in our rented flat that we currently live in now. They took all my student loans details etc and the 'computer said no', he couldnt claim. No reason was given. Could anyone please tell me why this is?? I dont even get the full amount of student loans. We have no other income, how can we not be eligable??

Could someone please tell me what is the 'criteria' for LHA? What needs to be met?
Whats the maximum income allowed to still get HB?

    No, he cannot claim LHA if living with parents.

    It would appear that your student income plus his JSA is more than the applicable amount for you to claim LHA. You could ask them for a breakdown of the calculation if unsure.

    okay, just an example, if your parents charge him say £50 a week board and lodge, how much would he have left from his benefit after paying this.

    £20, £25, £30.

    I bet a lot of pensioners would give their left arms to have £ that amount to call their own as 'pocket money' after their living expensse had been seen to.
    make the most of it, we are only here for the weekend.

  • dmg24 - Its not his parents (just to be clear) its mine. I'm only 19 so do they count 'boyfriend and girlfriend' as partners?? Thanks for the info though, I will ask for a breakdown. He gets £50 a week JSA and I have about £50 a month left over from my student loan after my rent has been paid. But he cant pay his half of the rent.

    My parents want to charge him as much 'proper' rent as possible. So whatever he could get in HB they would want. Theyre not doing this as a 'favour' as such. They could do with the extra income, and he needs a place to live.

    of course hes classed as your partner. you talk about his half of the rent...............if your a couple the rent is yours together, not half yours and half his. so your income is your grants plus his JSA

    i'm not certain but i dont think you can claim housing benefit to pay rent to a close family member if youre living in the same house. your bf is living with you as husband and wife so i would think that he'd be classed in the bracket of 'family' too.
    i could well be wrong but no doubt someone will be along to correct me!

    Thanks, I think your probably right. He will just have to find a job or use his JSA then.

    Also.. The job centre have put him onto Contribution-based Jobseeker's Allowance. But we have just realised that its based on how much National Insurance you have paid in the last two tax years.

    But he hasnt been working in the last 2 years. Hes been in full time education.

    Is this the wrong Job seekers for him???

    the NI years that count would be 07/08 and 08/09

    If he is on the wrong JSA I would encourage him to get a job very quickly - your student income is likely to cancel out any income based payment.

    He will not be able to claim LHA if living with you in your parents house.
