Carphone Warehouse/iphone/Web Bolt = problems

Hi all
I purchased an iphone direct from apple about a year ago. Put my contract sim in and all was fine. However when my contract was up for renewal E2Save/Carphone Warehouse offered me a cashback deal. I told the sales person that I have my iphone and do not need a new phone. They told me that my sim wouldnt work in the iphone, I informed them that I had been using it in for the past 8 months. So I kept my contract the same, with the web bolt on the same also. It has been 3 months since I renewed my contract and I have realised that they have been charging me for internet usage on my phone since taking out the new contract. They are refusing to refund me as I am not on an 'iphone contract'. I am quite prepared to take them to court over it because it was mis-sold, they knew what phone I intended to use the sim and web bolt on with. I have been totally fobbed off by their 'customer service' and 'complaints' department, I am swaying towards cancelling my contract without notice. My husband has done exactly the same, so between us they have taken nearly £250 in internet charges.
Just wondered if anyone had experienced a similar thing? And also if I cancel my contract would I be able to keep my same number and get a contract direct with O2?
