The OP also says it was settled out of court.

You can, of course, settle out of court once proceedings have been issued.

im glad you sued comet as i cant stand them but it sounds like the transit bolts were not removed from the back of the machine upon installation, it would have been a 2 min job to rectify it, the engineer should have realised this and it is stated in the manual!

Another reason to hate Comet is the awful Edith Bowman voice over on their adverts.

Well done, I can see why you were sucessful..

    1) Comet clearly messed you about and the machine was faulty

    2) Your OP was clear and factual, which im assuming your complaints letters and forms were too, complaints full of waffle and anecdotes dont help, and this must have helped in court!

Glad to see you stuck to your guns, can I ask though, why did you want a replacement? Personally i would have wanted my money back to spend on a different model (therefore avoiding the possibility of getting one with the same problem) and then buy from somewhere else, hopefully with better custoner services.

i originally said give me a credit for the machine and i will pay more for a nicer one to which Comet refused. i requested a replacement but i knew i would not get the same machine -- i want a replacement of same quality and features but different make so that i can avoid the same problems.
  • So you missed out of £200?

after 6 months of hassle, i think the £300 was sufficient. obviously i would have preferred £500 but even when i went to court, the judge was suggesting i accept £200 becuase it was a good offer -- i obviously didnt agree but im happy wiht the £300. its way better then the original £25 voucher they offered and to wait until august for teh second court date and have to take another day off work it was worth settling to me
  • i stil deal with the banks only because i have to -- sky is the only provider in my area so i am stuck, and NHS... i no longer use the hospital i had problems with. Comet i will never shop at again

    Whose decision was that?
    Yours or Comet's?

Congratulations on your win - hopefully you've made their customer service a little better for the rest of us too :)
  • I bought my daughter an Acer Aspire 7535 laptop from Comet in October of last year using my Credit Card. Oddly, I was not offered an extended warranty. She has been using it successfully but when she tried to use it over the weekend she found that the screen display no longer worked. When she took it into Currys yesterday, they said that she had damaged it and although there was a year's warranty, she would have to pay for a new screen.

Some local IT repair people have looked at it and said that the opening and closing of the screen lid has caused the damage - the screen is very thin and flexes when opened leading to failure. A new screen will not necessarilly last any longer than the last one did unless the laptop is opened & closed with great care!

It sounds to me like "not fit for purpose" so I am going back with her today to see how they would feel if I start a case using my Credit Card protection - I will keep you informed....

Well done OP, its good to see consumers stand there ground and prove to these Goliath style companies that in the end, the customer is always going to win when it comes to consumer rights, from the "not my problem" attitude to literally begging you to settle with them, before the inevitable "not a prayer of convincing a judge the customer isn't entitled" pleas.

All the more reason why they opt to first try n fob the customer off until the very last minute, before caving in and offering the customer a full refund plus perks, in some vein attempt to change their minds before a judge makes the decision for them.
