As an immigrant perhaps I can help. Do he have Limited Leave to Remain or Unlimited Leave to Remain? If it's limited, he will be deported when you divorce. If it's unlimited, which you can apply for after 2 years, he can remain and still apply for citizenship.
I seperated 5 months after receiving my Unlimited Leave to remain. It was an unrelated timescale, he was a jerk. He did try to contact the Home Office and make trouble for me, but I was in the legal right.
You can apply for divorce - put into google 'family court' and your local council. You will ge step by step instructions and the form you need to fill out. He doesn't have to agree to it, and he can even refuse to sign the forms if he wants to.0 -

This is helpful to no one, nor is is very friendly. To be honest I don't think its much of a surprise if someone who has immigrated happens to know more, than people who haven't, about the procedures of immigrating...?! Come on.0 -
why shouldn`t an immigrant know about procedures? perhaps she has educated herself about these things,as any one would living in a strange country.
I lived and worked abroad for several years and I had the sense to find out about the laws regarding work...its common sense0 -

You are right. I'm ashamed to say my comment was not helpful; neither was it friendly. Immigrants coming into this country are bound to have a sound (and very thorough) knowledge of procedures......0 -

as would an emigrant, to Australia for instance....if they have any sense. I certainly knew laws pertaining to me when I was working abroad.

And that is the beginning and end of my reply to you. I have lived here far too long to engage in these conversations anymore. I've had far worse said to me - an American living abroad during the Bush administration has to learn to have a thick skin!
On another note to the original poster - I understand you being angry and upset after the split, especially as you feel threatened by his behaviour. Pushing someone so angry probably isn't a good idea. Just get the divorce sorted, apply for it on the grounds of unreasonable behaviour. Even if he ignores the petition and info from the court, you'll just have to pay a bit more to prove he was sent the paperwork. He has a set timeframe to reply. Again, your local famly court will have it on their website.
Is your wanting him deported because you're angry with him? Is it worth pushing this issue? Eventually this will get picked up by the Home Office without your intervention. Especially as the Tories will be pushing again for all dirty foreigners like me to carry id cards. If you get angry and tell him you're going to try to have him deported will only inflame the issue, which may not be a good idea if you're already frightened of him. There are loads of government procedures in place to keep an eye on immigrants.0 -

iamana1ias: no I was not paid to marry this man. And also if you read what i wrote, i have been waiting 2 years to start the divorce because I am saving the money for it. You might want to keep your un usefull hurtfull words to yourself in the future. Yes- everyone is entiled to an opinion but like this when you are just being hurtfull0
