Disqualified after passing driving test?
Options
Friend's son, aged 18, has just passed his driving test. Last year he was caught driving a car and was given 7 points for driving uninsured and on provisional licence. I know that if he gets 6 points on his licence after passing the driving test he has to retake his driving test. Does the 7 points he got before passing his test makes him already disqualified and that he has to retake his driving test?
Thanks in advance for the replies

I don't think so but any future points would definitely result in disqualification0

You can only tot up 6 points in the first 2 years of passing your test before you are banned. So if he has 7 already, then he will be automatically disqualified on passing his test.0

Yes, you can only tot up 6 points AFTER PASSING YOUR TEST - you can still take the test with points on a provisional and you're not automatically disqualified after passing, however will be for future offences.0 -
I would play safe and seek expert advice on this as there are differences of opinion - the last thing he wants is to drive when he is disqualified on a points basis and then be disqualified for driving whilst disqualified! The insurance costs are going to be horrendous anyway.0

If he had been disqualified, surely he would have received some written communication from the DVLA to confirm this (and may have been asked to surrender his licence? )."You were only supposed to blow the bl**dy doors off!!"0

You are not banned or disqualified if you get 6 pts in the first 2 years ....your licence is revoked. It is a different process which means you do not have a licence any more at all, and have to reapply for a provisional, take theory & practical tests etc.0 -

I see, that is even worse.0 -

That is correct. The licence is revoked by DVLA."You should know not to believe everything in media & polls by now !"

From what this says http://www.direct.gov.uk/en/Motoring/LearnerAndNewDrivers/NewlyQualifiedDrivers/DG_4022566
If commits another road offence in the next four year is licence will be revoked.
Serves him right really and not really of much concern of yours. He'll have to pay though the noise for insurance also which is properly the best punishment, shame the extra insurance cost go to some insurance company.0 -
Penalty points gained before passing your driving test
Any penalty points you gain before passing your first driving test are taken into account. However, having six or more doesn’t mean your licence will be revoked straight after you pass your test.
Gaining further points after passing your test, taking your total to six or more, will mean your licence will be revoked.
Ie, if he already has 7 points, any more will get his license revoked as he automatically has more than 6. Its all about the total points and existing ones still count.
e.g if I had 3 points, passed my test and then got 3 points for speeding my license would be revoked as I have over 6 points.0
