Well this is a difficult one!
My brother is not the most trustworthy person and has got himself into a lot of debt, he has the same name as my dad and after getting his credit report it would seem he has run up debts in my dads name and dob.
I believed my only option was to write to debt collection agencies to dispute debt as this isnt my dads debt but will this then get police involved for a case of fraud?
Any help gratefully appreciated! x

in normal situations a creditor/debt colections agency will not accept a dispute on these grounds unless the police has been/are involved
this is because a lot of people will and do try to use the 'i didn't apply for these or use these' lines to get out of paying for debt they did actually build up themselves,Drop a brand challenge

This debt is with Lowell Portfolio for £1050 which appears to come from Littlewoods catalogues. obviously my dad doesnt want to get his son in trouble but he has a default on his credit report now as well as all of my brothers debts associated to him! x0 -

In practice, the police will refuse to take a report from you regarding this; your bro has defrauded Littelwoods not your dad.
What you can do if you are nervous is go to the police station and ask to see an officer about "what would happen if". Someone I know did this with regard to a much more serious matter before deciding whether to make a formal complaint.

well this has to be down to your dad,
if you want to dispute this to get the default and amounts 'wiped out' you will have to contact the police and start a ID theft/fraud case so you can get the 'crime number' which you can then provide to the debt collection agency as proof for you dispute
however if he doesnt wish to get his son in trouble he will just have to 'take it on the chin'
i am sorry i dont have any further advise however i dont know any other options in this situation.
just try to bare in mind that if you dad does take it on the chin this could give the go ahead to your brother that he can do it againDrop a brand challenge

I understand but how would they find out that it was my brother that has run the debt up? I no its from a catalogue so the stuff he ordered he sent to our address not his own therefore he has had the goods! I just dont know wher to turn and feel so sorry for my dad as he cant even get a small overdraft even tho his only debt is his small mortgage which is paid on time every month! x0

No. he has to prove that he did not sign up for Littlewoods. In fact, Lowell have to prove that dad signed up for Littelwoods, not the other way round.If you've have not made a mistake, you've made nothing0 -

Yes, dispute the debt but be aware that it MAY end up with a full investigation and your brothers involvement will likely be uncovered. It may be that he applied in his own name and DOB but Littlewoods have been extreemly careless and found your dads details and registed it against that... it COULD be perfectly innocent... but yes it could have been your brother being naughty. Have you asked your brother about it? Maybe if he realises that HIS debt is now directly causing your dad problems he'll help you sort it...DFW Nerd #025DFW no more!
