problem with visa debit card payment.

hi there i have a problem. i orederd some heating oil for our house online on the 26th april. i payed by visa debit card and recived an email excepting payment. a few days later i checked my account and the money hadnt been taken. the oil arived on the 6th may with pre payment recived on the delivery note. i then thort they must have taken the money and as i made alot of payment to things i decided i must of just missed it on the statement. they then took the money out of my account on 8th may. what are my rights as i spent any funds in my account beleiving it was mine and i thort when you pay for things over visa debit card they have some sort of gaurantee the payment will be taken withen a certain amout of time? do i have any rights for complaint or is it just all my fault? any help would be great thanks!!:beer:

    im sorry i didnt make it clear. they havnt asked me for the money they just took it out of my account which has put me over my overdraft limit. im not trying to get something for nothing or just thort that i had some rights that they would have to take the money out of my account when i orderd the oil. i dont understand how they can take it out two weeks later without me agreeing to it.? dose it mean that when you use your debit card they dont have to take the money within a few days? i think 2 weeks is a bit harsh am i wrong?

    Its just your fault by the sound of it, sorry to be harsh.:eek:. Depending on what Bank it is, if the merchant doesn't take the payment within 4 days, it drops back into your account as available spend. However the amount has been given authorisation and the merchant has a voucher valid for 6 months and can present it at any time and the bank has to pay them whether you have got the money still in your account or not. Its up to you to ring fence the funds so they are there for the merchant when they come looking for it. Usually this is done for you as most transactions are taken within the timescale that the bank holds onto the money. But occasionally it goes over,

    I have one waiting to come off my account for £61.11 at the moment and its gone over the 4 days so has been put back into my account, but I have do doubt it will come out in the next few days.

    It is not 4 days with all banks, just the one I use. I believe its 10 days with Halifax, and its 4 with Santander, from past experience.

    im sure that has whats happebd then. i think that its a bit wrong that they can do that for so long afterwards. the reason im asking is that when i booked a few flights last year one of them took the money twice but like you said the money was put back in around 4-10 days later. id assumend that the oil company had done the same. thanks for yourhelp

    I think they have 6 months to take the payment, unfortunately you not checking isn't their fault, and as for "i dont understand how they can take it out two weeks later without me agreeing to it.?" you did agree to them taking the money but didn't keep an eye on how quickly they did this.

    No, you agree to them taking the money. Neither side specified a date on which this would be done, you just assumed (like most people would) that it would be withing a few days, but they do have up to 6 months to take it.

    I thought the system was you agree an amount of oil, and cost, give them your card details, then they come and fill up the tank. If they can't put in as much as you agreed, they just charge you for what it took to fill the tank. Sounds like this happened to you, as the payment was taken two days after the tank was filled.

    Sounds correct to me, I would be more surprised if they took the money before delivering the goods.

    As mikey72 has mentioned, what would you have done if there was only room for half of what you had paid for when they tried to fill it??

    Let's get it straight. On 26 April, you agreed to them taking the money. You did not set a time limit. They took the money on 8 May. They did what you said they could. Where is the problem?
