Vodafone exchange policy

Recently upgraded my contract with Vodafone to a HTC Desire on a £40 per month 18 month contract but had a problem with handset within the first 2 weeks of ownership and the handset was exchanged for a brand new handset.
Within a few hours of ownership, I noticed that dust was appearing under the screen. A call to Vodafone customer services followed and an exchange was arranged, but all they could offer me was a refurb unit.
Not sure where I stand here as the I'm within the first 28 days of ownership.
Can anyone provide some guidance here?

For the first 28 days your are entitled to a new product, after 28 days it is a refurb.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
