Please Help, Paypal is the enemy

Hi Folks.

Ok, a buyer opened a dispute on paypal stating an item had not been received by me the seller. I put tracking number on paypal dispute message thing and communicated with the buyer. The item was received & the buyer wrote this in a message. However the buyer then escalated it to a claim and today paypal have refunded the buyer the full amount. Now Im really mad. It was a mobile phone which sold for £130 on ebay so now I am minus £130 in my paypal account and have no phone. :mad:

I am going to call paypal tomorrow, how can they justify refunding the buyer when it clearly stated the phone was received???

I'm worried that my money is gone forever. All advice/ past experience will be appreciated.

  • If your buyer has signed for the package then you can get proof from the royal mail, this is free for Special Delivery and about £2.15 for Recorded Delivery.

    www.royalmail.com - enter parcel reference and then click proof of delivery.

    The buyer will have no defense for claiming a refund when he/she has indeed recieved there item. I sure paypal would have no choice but to issue a reverse on the refund and you would then get your money.

    Failing that contact the buyer saying you have proof of delivery, they have fraudulently claimed for non-reciept, if payment is not forthcoming you will start a full claim in the small court against them.

    Thanks. I forgot to mention the buyer is in India. So tracking on parcel only proves that it left the UK. even so the buyer has said the item was received on the paypal dispute page. Do the people at paypal not read the messages?????

  • Paypal only covers you if ALL of the following applies:
    • Item was sent to UK/USA/Canda
    • Item was sent to confirmed/verified address in these countries
    • Item was sent with a method that can be tracked online
    • Item delivery can be confirmed online

    Unfortunately India is NOT covered under Paypal's Seller Protection. Therefore even if the Pope himself delivered the phone witnessed by 20 Archbishops with photos to prove it, Paypal may still find in favour of the seller.
    You can attempt to dispute this by sending the proof you have but don't hold your breath.:confused:

    Also you have a double whammy, as you can't even claim from the Royal mail for loss as they no longer cover phones over £32 in value sent overseas regardless of how they were sent.

    Paypal are very strict on their acceptable posting methods, so you have no appeal unless you followed their recommendations to the letter:

However, since availability of delivery details cannot be predicted, sellers may not be able to rely on this method for proof of delivery in order to be covered by PayPal's Seller Protection Policy.

    You should never send a phone anywhere outside the UK.

    You've been scammed. Sorry :mad:

    From my experience, paypal won't give a toss about you. The reason they gave the money back is probably because the buyer used a credit card, so would have just done a charge back anyway, regardless of whether they have got the item, so paypal are simply protecting themselves for any losses they may incur.

    I used international signed for. I already knew it was only covered upto £32. The lady in the post office said its just india that wont cover anything over £32, not just phones its a recent thing thats been brought in. I have sold several items to foreign buyers with no problems including India. Ive got to fax off proof of postage to appeal it. I dont hold out much hope.

    You have no hope, paypal themselves do not fully recommend the use of International signed for and warn that it is not tracked to destination. Therefore I can't see what argument you can use to persuade paypal otherwise.

    Spoke to paypal today, & the lady i spoke to said she doesnt understand why paypal refunded the buyer when it clearly states the item was received. The accounts department will call me in the next few days. In the mean time my buyer has emailed me to say thank you!!!!!!!!! Oh my god, talk about rubbing salt into the wound.
