Well now; as many on here know I have been warning about all cpw companies for at least three years - even get regularly attacked for so doing. However, in your case 1) you said that you "forgot" about the original cashback denied claim, yet b) almost a year later walked into another false promise and c) know there are warnings about cpw all over the internet. I have dealt with various cpw companies in volume for 4 years and never let them get away with anything; I also did my research beforehand (it was substantial and took a year) and cover myself every step of the way so that I can sue if needbe.
If they have "got away with it" in your case it's because you laid yourself wide open and let them. Having that experience should at least mean that you won't get hooked in yet again by them. With all things, if you don't/can't take immediate action when such companies don't serve up exactly what they promised, then don't do it in the first place - that alone more than once!0 -
I think the problem isn't so much that they can legally 'rob you', but more that the issue of their mistakes and poor staff wasn't forced at the time. Don't let them ignore you initially, you have to remember in disputes time is of the essence and when it drags out, things can get more difficult and positions change.
It also shows the major problem with low paid staff on commission based sales. When you need 1 more sale to get £250 you'll do anything- safe in the knowledge that you won't be sorting out or even around when it hits the fan. It is one reason in my last employer I always stated no to it when asked. As others have said, although it doesn't help know, in the future get things in writing- you'll often get told it is a special offer time limited etc!0 -

O2 completely screwed up my accounts with them, cancelling the wrong SIM, transferring 2 SIMs to 1 account, leaving me paying line rental on an account with no phone numbers attached! (It's a long story.)
Anyway, O2 kept failing to look into the problem, so I phoned them every hour on the hour (using their 0800 number) explaining how the average call to a call centre costs around £10 in overheads to the company, that I had made X calls so far, costing them £Y, and wouldn't it be easier if they just refunded the small sum of money that they owed me. Every time I insisted on speaking to a manager or arranging a call back.
In the end, they knew me by name and it took only 3 days to receive a full refund. It looks like the Carphone Warehouse have a few 0800 numbers - maybe you could try the same trick and see how if they get sick of you calling and pay you off!0 -

Slight correction, MJ. Your warnings about CPW companies are in the main correct and your advice on how to proceed if anyone does do business with them is spot on.
It is the manner of your rhetoric at times that has caused some of us to comment adversely on a number of your posts. Not the content of the message, just the tone etc.
But when you rein in the rhetoric, you are one of the best sources of advice and experience on this forum.0 -
Have posted about CW on another thread. I think the only advice is -avoid them like the plague.I took in a phone to be repaired-seemed quite simple at the time. Their recording systems are chaotic-my poor phone had two screens linked to it, with contradictory information.Some Complaint staff don't know about the two screens.Six weeks + on I finally managed to get the phone back but had to handcopy the notes from their screens in store.essentially the note with the phone said 'No fault found', although the screen notes from the same engineer said 'no parts available' to mend the fault.The shop manager couldn't understand the difference and became threatning and abusive.
I'd like to give advice but I can't-it took long enough just to get my phone back.the manager's behaviour was a real eyeopener.if it had been a backstreet garage it would have been unacceptable but from a major High Street retailer ?!
All I can say is -good luck and never never deal with them again

Do you have an itemised phone bill? If you can show that you have been calling them constantly to sort this out, it may help in whatever action you take as you can show you have made every effort to resolve the issue.....0

UPDATE
I tried to call the Repair Centre to see if they could clarify what had happened to my phone.Bloke was quite helpful but
there was confusion as to who had actually written the notes regarding the repair/parts.The 'engineer' named on both the repair note and the database entry was apparently an admin person who rubber stamped substitute phones when the original couldn't be repaired
As for the charge for the repair notes-it doesn't exist- but you do have to pay for a Subject Access Request to find out what happened !! So what happened to my phone remains a mystery.
All I can echo is what others have said-keep careful documents to show you've tried. I'm now going to write to Head Office-no point in trying another layer of Complaints
