HELP! I urgently need assistance with Vodaphone

Hi all

Please can anyone help me with this query???? - :D

Feb 09 bought a c905 phone via tele sales rep of Vodaphone - deal was £20 pm, 900 min, unlimited text, internet for a 12 month contract. :)
Feb 09 Received the phone but no paper details, contacted vodaphone and asked for paper copy to be sent home. I complained and was sent from one dept to another and had to perservere the next days because the dept had closed!! I kept being told "don't worry your 14 days trial period" is ok and you can still send phone back when issues resolved.
Mar 09 realised that it was £35 per month, 700 mins and 18 months contract,
Feb - Apr 09 rang after work, took days off work for hours on end and explained that I was sold a deal and charged a more expensive deal, they said I had bought it off the web - which I did not! They said it was too late to send phone back, they would not listen to recording made on the day, even the hour I agreed to the booking, Managed to speak to the managers on rare occasions and again loads of b......t!

The charging component never worked but I charged using various rubber bands!!
I have been lowering the monthly rate eventually and am paying £15 pm for not a great deal.
Apr 10 the phone stopped working, Vodaphone shop said it was a simple software issue. The phone was returned and Sony Ericsson who did the repair check said it was not economical for them to fix as the mother board is broken and that the customer is at fault.
I AM STILL UNDER CONTRACT UNTIL AUGUST 2010!!! I was told by the vodaphone rep that I should have insured it and it would be fixed.:(

Q1 - How can I cancel my contract as the phone is not working?
Q2 - I shall never be buying Vodaphone again but can I do anything to get compensation for my lost work days, phone bills, stress time for me and my family and the heartache for a rubbish birthday present???
Q3 - How can I get Sony Ericsson to fix the phone as I can guarantee that I have not broken it...the phone hardware is all intact?!
Q4 - Any other advice I need?

Please, please, perhaps Martin Lewis - you could help me??:)

Grateful any advice.

Q1 - How can I cancel my contract as the phone is not working? You can't - the air time contract is separate.

I think you need to stop beating your head against the brick wall. The time to have sorted out your main complaint was way back in Feb 2009 - I expect you know that deep down.

If Sony say the phone is broken because of mis/over/careless use, you are not in a position to argue without expert help to the contrary. And it is a 15-month old phone.

So - buy yourself a £10 phone until August and then get a PAC code and get out of the Vodafone network upon your 18 month contract ending if you don't want them any more.

In fact, why don't you buy your own phone and go on a 30-day sim contract in August. Do the arithmetic over an 18 month period and I bet you will be quids in.

In the meantime, you are going to have to live with the last 3/4 months of your contract. Grin and bear it, then get out of it as soon as you can. But do think twice about 18 month contracts and how that ties you to a broken phone or bad reception if you move home. See other threads.

Thanks for your advice...I was hoping that I could end the contract now as I do not have a working handset. I understand that I should have resolved it last year but I did bang my head against the wall for over a month and then gave up as I was getting nowhere. I feel unhappy when it stopped working now and they will not repair it - with it still under warranty.
    Thanks again.
