Warning about VERY ,is this even legal ?

Hi ,just before Xmas I started shopping with VERY ,I ordered and paid in full at the time of ordering .After Xmas I ordered again ,did the same ,gave my card details and paid .
I received a phone call from VERY a few weeks after the latest order ,asking me to open a credit account ,I refused and stated that I always like to pay in full at the time of ordering .
Next thing I know ,I receive a Statement ,they had not taken my payment ,instead they had opened an account and I hadn't made the monthly payment ,they added £12 on as charges ??
Eh ? What account ,what monthly payment ?

    Don't you have to sign a credit agreement to get credit? If you've not signed anything (or agreed to it) then I doubt they have a leg to stand on. Write to them explaining the situation and the time/date of the call (they likely record them) so they can review the tape and hear that you agreed to nothing.

    No I never signed or agreed to anything .
    I have been in email talks for several days and they just keep saying the same thing over and over again Grrrrrrr.
    To think aswell ,I recommend them on here for fast service ,after my first order!!

    Isn't it just a simple case of providing them with your bank/credit card statements to prove you paid in full at the time of ordering??

    They are a pathetic company with an even worse complaints handling procedure.

    Make a complaint. They have 8 weeks to investigate and respond after which go to the Financial Ombudsman Service. One of those rare instances where a retailer is governed by the FOS.

    They shouldn't have to make a complaint though, all they need to do is send a copy of the statement showing they paid (you can black out all the rest) and that's the end of the story.

    On the flip side, I've used them for years and never had a problem with them,

    No ,like I said They never took the payment ,they too my CC details then never took the payment ,instead opened me an account ?! :(

    Didnt you look at your statements and realise they hadn't taken the payment??

    You don't have to sign anything when opening an account, you just have to tick a box to confirm you agree to their T&C's.

    I would write to them and enclose a cheque for the amount of the goods you brought. Tell them that this is your offer in full and final settlement as you never asked for an account to be opened.

    If they cash the cheque, they've accepted it in F&F.

    It is very recent and we have only received one statement .
    Wasnt checking online as I have been ill and in the hospital .
    I had absolutely no reason to believe that the goods were not already paid for .
    To be honest ,even if I had a statement earlier ,I dont think i would have noticed a payment for #£50 + not going out amongst hundreds of transactions .
    I scan down my statement to see that all the outgoings are legit and I recognise the names but as for an outgoing being missing ,I dont think I would have noticed ?!

    So they took the payment for the goods you ordered before x-mas? It sounds that way, as you would have had 4-5 statements since then. I

    I would still stick to what I suggested above, send a cheque, but be sure to write "This is in Full and Final Settlement" as you never requested an account.

    If they don't cash the cheque and persist, write to them again and ask for proof that you opened an account, then write to the FOS and advise VERY of this, they may then back off.

    Oh yes sorry ,,the first order went fine ,it was only the more recent order ( after the phone call asking me to open an account ,which I declined )
