    There was only one reason I left it ther and that was because my sis in law said shed collect it...

    I also see where yous are coming from but are yous involved in any insurance companies that deal with this or is it just word of mouth?

    I dont believe it was neglect and it was definetly an accident....

    But thanks again for your opinions....

    Its common knowledge cars are on the pavement, and seeing as the car was parked up, surely it would be obvious its already on the pavement!

    Even then, there's still the risk of theft or other damage.

    Just to better illustrate the point, swap a laptop for a a child? Would you think it an accident to leave a child behind a car outside on its own? All the circumstances are the same just two different objects. I'd be hard pressed to think of anybody considering a death of a baby on those circumstances an accident over neglect.

    If you feel so strong your only option is to write a letter before action asking them to reconsider their evaluation and that if they do not, you will take them to small claims court. You will have to pay a small fee etc. and hope to god that the judge agrees with you but IMHO its quite clearly neglectfulness that caused the damage. as this was very easily avoidable.

    if you want answers from people insurance background then ask in the insurance forum ;)
    for me it was neglect,you placed the laptop in danger in an envirment it is designed for or would be expected ot be
    eg had it feel off the couch and broken,i could see thats a side effect of typical laptop use
    placing a laptop somewhere a car can drive over it,well thats not a typical environment for a laptop
    if it was in that situation you would be extected to be vigilant for its safety
