Okay, received a letter from Franklin international thanking me for informing them of the situation with cap1 and have put my account with them on hold until cap1 get back to them...still no CCA from cap1 (1st letter sent the 3rd ish of May)...
I think all my creditors 6 months thing is up as egg recently decided to tell me theyre passing my debt onto an outside collections agency and ive noticed Amex are starting to add interest charges again...totally pointless paying as my debt will never come down...interest is more than my offer of payment...
Debating whether to involve National debtline to see if an IVA is optional...bit like an ostrich id prefer others to deal with the creditors as theyre obviously not listening to me...0 -

Received a letter from cap1 on the 2nd of June saying that theyre looking for my CCA (im assuming) and it will take up to 4 weeks...now this morning ive recevied another worded the same saying that it will take them up to 4 weeks from todays date...ive already waited 3 weeks since the last letter informing me itll take 4 weeks and now theyre expecting me to wait another 4 weeks again.... Im hoping the longer it takes them the more my case seems to be in my favour...is this usually the case with other peoples experience??
shame i cant charge them a late fee for missing the deadline like they are keen to charge...0 -
Well Cap1 have sent my CCA request, can someone have a gander at it and let me know whether to restart my monthly offer again...
The only thing i noticed is that on the terms and conditions page where my name and address were they have used a "B" instead of an 8. But i have moved since then and everything is now sent to my new address. I cant remember signing a new address sheet, i maybe wrong.
Anyway Id be grateful for an expert to look at it and let me know. Cheers.

The only signature box I can see is on the first page - headed application form?
If so, I do not think this is not a legally complaint CCA. the signature box needs to include the prescribed terms and none of them are even listed on the page.

The debt with cap1 is my smallest debt, all my creditors accepted my initial offers except cap1.
Theyve been the least helpful, atrocious customer service via bombay, constant phonecalls and threats, monthly charges and interest, yes i owe them money and ive every intention to pay it....
BUT the stress that theyve put me through having dorks hammer on my door, constant phonecalls and letters yet ignoring my pleas for understanding etc etc i think im entitled to make them wait till i feel ready to resume payments to them...if theyre not legally allowed to chase the debt then ill send them a pound a month.
Cap1 are the scummiest company to deal with and i feel sorry for anyone who is about to try a DMP with them.0 -

Not quite accurate.
They can ask you to pay but you can defend any legal action. If you know your onioons, you will ensure that you tell them the debt is unenforceable and report them to the OFT if they continue to haress you.
If there is no default on the account, they can still put one on your credit file if you stop paying.
If the default is there already, as it will probably be if you are on a DMP, then they cannot do anything else, providing you defend any attempt at court action.If you've have not made a mistake, you've made nothing0 -
I havent arranged a DMP with any company, ive asked them all myself and all bar cap1 have agreed to reduce payments...although im now starting to get letters saying that the 6months are now up and they want the full amount etc etc plus the interest is starting to be added again...square one and back to spring to mind....0
