I know there are other threads on these scumbags,my query is that :
I owe £450 to cap1,sent them the offer i can afford of 3.63 then cap1 did all the ignoring that they do, ttansferring debt to debitas,since september with charges being added its increased to 700 quid,id never missed a payment and havent missed my token payments either.
Anyway i had a letter from power2contact saying theyll call at my home if they dont hear from me..i ignored it after reading other peoples experiences with them. Well ten mins ago theyre were banging on my door relentlessly for 5 mins,my neighbour came out and they asked him if i was in, he explained i work nights and they said well we need to speak to him.
They put a card through my door and left, what i want to know is has anyone had repeated calls at their home or just one? Also ive been with cap1over 12 yrs is it worth asking them for a copy of my c.c.a.? Cheers.

You need to send the CCA pronto.
Powertocontact have absolutely no power in law, at all. I have to go but you can write and withdraw the common law right of access to your property, then if they tunr up again, advise them you are calling the police.If you've have not made a mistake, you've made nothing0 -
We were visited at home by Power2Contact re: my husbands BOS Visa. I advised the guy that the account was in dispute. We have CCA'd them and know that they don't have our agreement. They continue to send photocopies of the application form which are worth !!!!!!.
I told them that the account was the subject of a complaint to the ombudsman and asked them to refer it back to HBOS. Haven't heard another word since, and the complaint is with the ombudsman as HBOS have continued to pass on the account for collection despite it being in dispute.

This letter revokes their right to visit you at home - and should be sent asap (probably to power2contact and debitas), along with the CCA request.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Just thought id update this thread....
after the above ive had no more visits from P2C, I sent the above suggested letters on the 5th of may, waited the 12+2 and then sent the reminder...this morning I posted the letter to Debitas regarding the debt being unenforcable due to the fact they havent replied yet have cashed the £1 cheque i sent them. Just had the post this morning and there is now a threatening letter from a company called "fredrickson Internation Ltd" Saying i need to contact them on 0845 3136612 to pay the amount in full to avoid further action...
My question after all this is that if I sent the Letters to Debitas (as they were the ones dealing with the debt along with cap1 for the past 7months) do I now have to do the same with fredrickson? do i keep sending £1 everytime cap1 decides to sell the debt? Ive cancelled my monthly £3 standing order with cap1 to enforce my letter this morning about the debt being unenforceable due to no copy of cca received...looking through the boards for Fredrickson they seem to be a nasty bunch worse than Debitas...surely there is a law with regards to cap1 ignoring all my pleas and debitas and now Fredprickson?
So to summarise...can someone help and let me know what or not to do...im not ringing an 0845 number and im not paying anything else until i see my cca..am i right??0 -

Re bumping updated...
Today I received a letter from cap1 saying thanks for your letter regarding your account, we are looking into your request but this could take anything up to 4 weeks, please be patient while we try to help you as best as we can...
( this was after my cca request and the reminder and the letter i sent regarding refusal to accept the debt)
My query is who the hell am I owing the money to? Cap1? Debitas ? Fredrickson International??
Ive stopped all payments now to cap1 since the 25th so its the waiting game now...?0 -
I think I'm right in saying that the debt 'ownership' will remain with whoever you sent the CCA request to - they can't pass it on as it is now in dispute, as they haven't managed to produce a valid CCA and the deadline has long since passed.
As no CCA has been forthcoming within the deadline, you don't have to pay money to anyone untill such a time as a valid one is produced. So, yes - waiting game time, with the chances of them winning it diminishing daily.
Debitas, incidentally, are part of Capital One (their 'in house' DCA) - and for a major laugh at their expense, try the legendary 'Having Fun With Debitas' thread - guaranteed to raise a smile:

Thanks for the swift reply Jesthar...its infuriating the way they word their letters claiming to be doing everything to "help me" yet have ignored all my offers and requests in the past. its been nearly 4 weeks now since i sent my cca request (4th may) they cashed my cheque on the 16th and are only now claiming to be looking into it (letter dated 28th)...its funny how they demand that we reply immediately or ring them immediately yet when we ask them for something they decide to tell us it could take 4 weeks to get all records in place.
Im not bothered about whether i have to pay or not as the debt is my smallest debt of all...its the bullying tactics they use and pathetic people in the foreign call centres they employ to ring you hourly...if i get out of paying it then great i save £3 a month...if i have to pay it...well its still only £3...

I think you will find that Debitas are the "collecting arm" of Capital One.
As for Fredricksons - the debt is in dispute and as Cap One have replied shows that they have not sold the debt, other wise they would have said so.
Fredricksons can not do anything at this point.I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0 -

It also stops them denying they ever received any letters from you!
If you haven't told the call centre drones to please stop calling you as you will deal with them in writing only, next time they call tell them exactly that and then just hang up. They are legally obliged to comply with this request. If they don't, and keep calling, send this letter:
