Losing License

I have a serious problem.

I currently have 3 points on my license for driving with a mobile (stupid) 2 years ago. I was flashed by a fixed speed camera a week ago and then a day later I was stopped by the police and told that I had no insurance.

I was shocked to say the least, I have been driving for 15 years and would never dream of not insuring my car. I had been insured for years with Elephant who, when the policy is due for renewal, write you a letter and tell you only to call if you want to cancel your policy or change any details. Not so for esure who require you to call them to continue the policy.

I understand that I should have took more care to read the details and the car was not insured due to my actions but I also think losing my license is a bit harsh for an honest oversight.

My car is not an old banger and therfore not insuring it would be crazy as if I was in an accident I would lose everything.

Do you think I should plead my case in court and risk a higher penalty or just accept the fact that I have been silly and take the ban???

    It's an absolute offense, so there's no getting out of it.

    You're unlikely to get banned. 6-8 points (so still less than 12 in total) and a fine of (I think) £200-£1000. Plus massively increased insurance premiums for the next 3-5 years.

    Its not really an oversight - they would have written to you with a renewal, and most insurers will then contact you again to try and get your business, and some will then tell you you are no longer covered.

    The implications for this are steep - lets say you have a fault accident and a child is injured and is left needing full time care for the rest of its life? Who pays?????

    Think you should brace yourself for the worst, although TBH if you had stolen the car and wrapped it around a tree you would probably be treated more gently for fear of you being scared for life or some such carp

    The courts tend to give you one chance to plead to them if you need your car for work/ existing etc. plead your case (PS - wife was a magistrate)

    didnt you notice no money had been taken from your bank for insurance

    Last Feb(2009) my daughter went onto the Tesco site for her car insurance. She worked for them and got a discount, so she moved over from the existing company. Paid for her insurance online which was to commence Feb 15. April 29th 2009 she was pulled over by the Police. ANPR showed no insurance.

    Long and the short Tesco had dated the policy from May 15 not Feb 15!! I know she/we should have double checked the policy dates but we didn't. And anyway she was driving uninsured between paying and receiving the documents

    She was stuffed because as you say its an absolute offence. Luckily she had been driving for three years otherwise her license would have been revoked. So 6 points and £200 fine. Luckily the Policeman who stopped her was a bit sensible and said if she could get the car insured there and then he wouldn't seize the car

    Ended up speaking to the PA to Tescos MD, and although she sympathised and could see where the problem was all we ended up with was 25% off her next two years insurance.

    Which she renewed last week with someone else as Tescos was dearer even with the discount.

    We all do via the MIB to which we all contribute I think about £35 as part of our premiums.

    Although the MIB can recover the costs from the uninsured driver if they have any assets

    In recent years I regularly check on ASKMID to confirm my car is insured...people make mitsakes so screw ups occur!

    most likely you will be banned! you will go to court for the no insurance bit anyway plea stupidity and youll be slammed just be apollogetic and point out you have no previous driving bans! if you were cought without insurance cops would of seized the vehicle! tell them it was seized quite rightly and youve learned a big lesson that you got to check your policy details, do you work? it may help if your job requires a car in order for you to carry out your duties and earn a living for you and your family highlight what will happen if you lose your job due to the prospect of loseing your job! take the hit when they decide oh and take a good amount of cash as the court may decide you have to pay the fine that day!
