O2 - upgrade my phone before contract end

Hi all,
My contract is nearly up with O2, was an 18month contract, and due to haggling I got their £35 contract for £20. I have two months left till I can upgrade legitimately, in other words three months until the contract actually ends, and my phone is mis-behaving - switching itself off, saying invalid sim, not delivering messages etc, all randomly.
So, I thought I'd phone O2, ask to upgrade early and just accept I'd be charged £20 a month for the remainder of my contract.
No such luck - apparently if I cancel I will lose my loyalty discount, and will have to stump up the full £35 for each month left. This is despite the fact I would be giving them more money in the long term, as I'd effectively be paying for two contracts.
Does anyone know anyway round this, as I'd like to keep my number and stick with O2 if possible...without getting ripped off like this! I know it's only £45, but it's the principal!

I called today to get an upgrade, all i got was a big fat NO! i have to wait another 4 days until my official upgrade date!0
