vendors lost corgi cert and refusing to pay for gas safety cert?

    I wouldnt get too excited about it.

    If the system is working and they are happy to state that that is so then fine. After all,they havent been sat freezing with no hot water for the last few months surely?

    Anyway the presence of a simple bit of paper means nothing.


    There are plenty of gas men (and wimmin) who are crap engineers and would sign anything or even sell a cert without even seeing an appliance in some cases.

    the seller is currently in breach of the law, and building control could take action. if they cannot prove that it was serviced by a competent person which the law requires then they could be hnding over a dangerous house serviced by a cowboy.

    you are on notice of this possibility and so pressure should indeed be brought to bear on the sellers to get it serviced now by a comptenet peron.

    if they won't then you should do it as soon as you move in.

    you might not think it fair, but most buyers would service teir central heating on moving in, just like one is advised to change your locks, s youdo not know the history of the property and so one would want to make it safe!

    I know that you need to have heating/boiler fitted by a correctly qualified person, but I was not aware that you had to have the item serviced if it is a home (different for rental).

    I have always bought property on a 'buyer beware' premise, so why would the seller be in breach of the law? Please can you give a link which details that the vendor is breaking the law by not supplying the info of service history.

    This is not a rented house so there is no requirement for gas certificates. It is up to the buyer to check out the heating system as with everything else about the house. Expecting the seller to pay for gas certificates, surveys, etc. is not how the system normally works. Caveat emptor!

    if so you have some leverage to get one.

    if no mention was made you have no leverage.

    As Clapton and others said, no requirement for a gas cert. I guess OP has previously rented property(?) where this would be a requirement.

    If OP is concerned he could have it done or sign up to BG or similar maintenance agreement which would initiate an inspection.

    This kind of thing happens daily in my job, for boilers, windows, electrics etc. I also often come across vendors that have paid for indemnities on the property they are selling, as their buyer has refused and also then have to pay for them on the property they are buying as the onward vendors have also refused!

    The weirdest indemnity I have come across was on a 300 year old house that on the original deeds had an unknown covenant on the front garden.

    As someone else has already said, it is not an obligation for the vendor to pay for this, most vendors see it as something you will benefit from so why pay. You could call their bluff and say you will withdraw if they don't don't pay, but be prepared for them to take you up on it.

    It really isnt something to put you off buying. Its a procedure the solicitors go through asking for certs and so on and to be honest, I dont think I could find any for this house if we sold up. I take it the system has been in use some time without exploding or poisoning the occupants, so why worry. Have it serviced yourself as soon as you move in, just to get peace of mind.

    The CORGI engineer we had was so useless OH ended up having to help him out doing the system.

    ask the vendor for the name of the engineer who did the service and find his name and contact details at GASSAFE and ask him for a copy - if he did it that is.......
