Atos medical, got a letter & have a few questions

Sorry I never posted on this before now as had a lot of things going on and kind of forgot about the thread somewhat.
First off the partner her tribunal very easily with 5 points more than was required. I sat in with her (and an advisor helping on her behalf present to) and found it rather interesting that she was asked mainly on what did effect her and NOT was was failed to be asked about her condition at her original medical. Funny how the DWP did'nt bother to turn up. Kind of like they knew she would win based on her appeal reasons yet tried to call her bluff!.
Anyways, to the member who suggested getting a doctors letter to state my condition etc and to take that with me. ATOS in my experience ignore pretty much everything you present to them other than medication as there "questionaire" to my knowledge does not allow for this at all?.
Anyways my medical was rather funny in a way. There was a language problem of sorts as the "doctors" accent made understanding some of his questions difficult. As was my accent to him it seemed.
Did'nt know we as the patient were allowed to look at the screen and see the questions and options the "doctor" has to choose for?. As for several questions he asked me to look at the question on the screen and even asked me a few times which of the options best suited the answer in my case for him to choose!?!?!?!?!. I kid you not, this must invalidate my medical right away. Probably should have recorded it like I wanted to but to many issues and forgot to borrow the digital recorder from a friend.
Another interesting point here is the IB50 form I filled in 6 months ago. What on earth has this got to do with ATOS and the medical lot?. As right in from of me at reception I noticed it there at the front of my file to the side the very form I filled in 6 months earlyer.
If all ATOS do is the medical then why do they need the IB50 form I filled in when all they do is the medical as asked to be done by DWP?. Is it normal for them to have the IB50 form of is this an interesting thing I noticed?. Because as said I have always said and claimed it funny how they often ignore questions and info put into the IB50 form that often never gets asked about yet if so would probably help to pass the medical?.

ATOS always have a copy of the IB50 because it is their job to assess people via the IB50 and via the medical.0 -
Record them but don't tell them that you are doing so. The gadgets are widely available and fairly cheap. You can record your medical by prior arrangement and using professional equipment. This will cost a great deal. ATOS will be able to advise you what requirements they have before allowing this to happen.
I do this routinely when dealing face to face with government officials. It's quite legal."Never underestimate the mindless force of a government bureaucracyseeking to expand its power, dominion and budget"Jay Stanley, American Civil Liberties Union.0 -

Having read all of the relevant postings re. recording of a medical assessment, there is I will agree no legal problem in doing so. However, should you need to use that recording as evidence, you may find yourself with problems over quality and having to prove that it has not since been 'doctored'.
One simple and fairly cheap way out of this is to enlist the help of a qualified legal secretary. These are to be found in clerical agencies in your area.
ALL qualified legal secretaries as part of their examination are that they are able to record court cases by way of shorthand. In addition most will have at least an A level in Law.
These people are used to record meetings, court cases and indeed, they used to record police interviews before tape machines were routinely used. They have standing in a court of law, and make excellent witnesses.
Just a thought and the cost would normally be for a couple of hours of work - a worthwhile investment!!0 -
Quality may be an issue, although these gadgets have come on by leaps and bounds. A friend recently purchased an up tp date concealed mini video cam and the quality was excellent.andyandflo wrote: »However, should you need to use that recording as evidence, you may find yourself with problems over quality and having to prove that it has not since been 'doctored'.
As to doctoring, simply offer to submit it it independent review. If there is no definitive evidence of doctoring, the expense is to be borne by the challenger. That shuts them up.
Many tribunals etc can and will exclude third parties, particularly if professionally qualified. Bear in mind also, that you want your opponents to be indiscreet.Legal secretary [...] Just a thought and the cost would normally be for a couple of hours of work - a worthwhile investment!!"Never underestimate the mindless force of a government bureaucracyseeking to expand its power, dominion and budget"Jay Stanley, American Civil Liberties Union.0
