    what outcome did you want ? do you want a refund or an exchange ? surly if you like fishing an exchange would be ok maybe for a diffrent rod ?

    AS you've passed the DSR regs return point. A court may well see that you've accepted at the item as it would been quite clear when the frist got the item that this was a problem.

    You need to find a independent qualified person to back you up, IE sounds engender.

    That is really poor advice. DSR is irrelevant here as the item is faulty.

    No way would a court accept that something bought last weekend has been accepted. In any event, a repair is not an option.

    Not quite sure why a qualified person is needed to back OP up. In the first 6 months, the onus of proof is on the retailer to prove that the item was not faulty.

    Not quite sure what "IE sounds engender" means.

    I think the circumstances under which the rod was broken needs to be ascertained as it could be relevant. Not having a receipt could also be a problem too if it was paid for in cash.

    Totally agree - however, it really comes down to whether it was an accident / misuse - not what fish the OP was trying to catch.
