Damage to vehicle - not a viable public insurance claim

Hi All

I live in a block with underground car parking. the gates were broken so we had to move out vehicles out of the car park. (4 weeks) we had to wait for a car park we pay for. evidentally my vehicle was damaged and I have to pay £500 for the repairs. I dont have comprehensive insurance for this so claiming is not an option.

I sent my email to the company that manage the car park who are usually really good. the money we pay every month for the car park covers the insurance.


Heres the response -

Although one of these residents advised that they left a message for Mark in connection with these gates some time before Christmas – Mark has no record of receiving this message. We do not have any record in our office of receiving a call from any residents in connection with these gates prior to your first email (we record every call on a repair log), and our out of hours service Orbis do not have any calls recorded either.

Therefore – as per my last email – Plumlife do not consider this a viable public insurance liability claim. You would need to contact your vehicle insurer to make any claim for damage. If your insurer feels that Plumlife are in any way responsible for the damage caused to your vehicle they will contact us to obtain details of our insurers. If this is the case please pass on my contact details.

I fell really dissapointed as we pay our money every month for insurance and we cant even claim on this. I know people who did report the issue but they obviously didnt want to admit to that.

any help or advice where I can go from here?

    If you drove from your car park to a supermarket, and your car was damaged whilst shopping there, would your Underground car park cover that claim?

    I can't really see how you can hold the management company responsible for the damage. Can you even prove the damage took in your alternative parking place.
  • nope, your looking at this from the wrong angle

    the fact that we had to move our vehicles because the underground car park was not available. and they did not fix the doors for weeks

    the vehicles were meant to be in there as we are paying for that/
  • yes I have multiple neighbours witnesses the damage as they chased the kids off the street.

    it was outside my property at the time.

    Still don't see why you think their insurance would cover you. Their PLI is to cover any damage occuring in the area under their control. I am assuming your car was on the public highway
  • yeah it was but the fact I couldnt get into my space was why the damage occurred

    You may have a claim for a refund on the charges for the period that you were unable to use the car park. But you cannot hold the car park owner responsible, either in negligence or contract, for the damage to your vehicle. The damage did not occur because you could not park in your space.

    You can pursue them if you want, but you won't win, and it will cost you money. They are not responsible, as I said above.
