Failed ESA medical.

    daska, I agree that some people withdraw from the WCA process because it is stressful, however I don't doubt that many more withdraw because they realise they are actually capable of some work. Ignoring those still in progress, that would make 40% decided to be fit for work, less than half of what was suggested earlier.

    Nothing wrong with b&w, most of the info on it is free, and some of the info is not available anywhere else, unless you do your own FOI requests. Plus, it would take a very long time to find all the info, elsewhere on the net, and in many instances, a lot of the info elsewhere is lies, like a lot of the stuff told on this site to discourage claimaints from recording medicals covertly etc.

    Would having a witness like my bf or my occupational not be enough or do you still think I would need to record my medical (when I get it)?

    Yes, as you state if you've received SSP you don't get sent for a medical.

    I received SSP for 28 weeks, £70.40 per week. It was my misfortune to have just changed jobs prior to the start of my health decline.

    So for someone to tell me I had to wait another 13 weeks for them to determine my medical status was unacceptable. To also say I had to have 3 days waiting period, when this is also done at the beginning of SSP is unacceptable.

    With the help of MacMillan I wrote to my local MP pointing out this "flaw" in the ESA procedure.

    It didn't help either that incorrect information was given to front-line jobcentre staff. Worse that they checked (I assume with their DMG?) at that time i seemed to know more than they did!

    Someone should list the questions that they are asked or the things they are asked to do but I don't think it's got anything to do with the illness that people suffer, it all about getting the numbers reduced.

    Has anyone been asked how their illness affects their day to day life?

    A witness can help, if you can get a professional witness like occupational therapist or whatever then so much the better, as if you complain, its a professionals word against another professionals.. They tend not to believe claimaints...

    It may also make them think twice about pulling a fast one if a witness is present....

    I record as standard now, I used the recording once for a reconsideration, won it, but was called in for another medical straight after winning.. Next one, I recorded but went for appeal, and the subject of the original medical was not even brought up at appeal so the recording was not used, then again, I was not represented as welfare rights did not turn up..

    If you have something that can record audio, I see no harm in recording it secretly, just make sure you dont tell them you are doing it, as they do not like any one to be able to prove what happened (they will stop the medical).

    Its rather telling they wont allow recording under reasonable circumstances, nor if your witness takes notes are they prepared to check those notes and sign them as a accurate representation of the assessment.. Nor will they allow you to read through the report they produce to verify it is accurate and reflects what you told them....

    Also, once you have had the assessment, ring up the ESA or IB people and ask them to send you a copy of the medical report (they will do so, and it is free) so you can see what they wrote about you and see if it bears any resemblance to reality, or belongs in the fiction section in the library like all my previous ones do..

    If you mean the amount of people getting assigned to the support group then yes, it's 8% of those who get as far as the medical. That's the 92% mentioned earlier.

    Round in a circle dmg24 but that's where the figure comes from... but of course, the figure ignores the people who haven't been assessed or who have closed their claim because of a reason other than being fit for work.

    I believe that the FULL RATE should be payable from Day 1.

    Why should we have to wait 13 weeks?

    Because that's what the regulations state? Why should you be paid full rate from day 1?
